This order is made under section 74(7) of the Fisheries Act 1996—

(a)

on the advice and with the consent of the Executive Council; and

(b)

on the recommendation of the Minister for Primary Industries made after complying with that section.

Order

1 Title

This order is the Fisheries (Schedule 8) Order 2016.

2 Commencement

(1)

This order comes into force on 1 October 2016.

(2)

However, clause 5 comes into force on 1 February 2017.

3 Application

(1)

This order applies on and from the first day of the fishing year starting on 1 October 2016.

(2)

However, clause 5 applies on and from the first day of the fishing year starting on 1 February 2017.

4 Amendment to Schedule 8 of Fisheries Act 1996

(1)

This clause amends the Fisheries Act 1996.

(2)

In Schedule 8, Part 1, revoke the items relating to ANG11, ANG12, ANG14, ANG15, and ANG16.

(3)

In Schedule 8, Part 1, insert the following items in their appropriate alphabetical order:

5 Further amendment to Schedule 8 of Fisheries Act 1996

(1)

This clause amends the Fisheries Act 1996.

(2)

In Schedule 8, Part 1, revoke the item relating to ANG13.

(3)

In Schedule 8, Part 1, insert the following items in their appropriate alphabetical order:

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order amends Schedule 8 of the Fisheries Act 1996 as a result of the division of stocks of freshwater eel in the South Island. The division is made by the Fisheries (Alteration of Quota Management Areas—Freshwater Eel) Order 2016. The minimum holding of annual catch entitlement for each stock is evenly divided between the 2 stocks into which the stock is divided.

The amendments for the division of the stocks with fishstock codes ANG11, ANG12, ANG14, ANG15, and ANG16 come into force on 1 October 2016, which is the start of the fishing year for those stocks. The amendments for the division of the stock with fishstock code ANG13 come into force on 1 February 2017, which is the start of the fishing year for that stock.

This order is a confirmable instrument under section 47B of the Legislation Act 2012. It is revoked at the end of 30 June 2017, unless earlier confirmed by an Act of Parliament. That stated time is the applicable deadline under section 47C(1)(a) of that Act.

The Ministry for Primary Industries produced a regulatory impact statement on 11 May 2016 to help inform the decisions taken by the Government relating to the contents of this instrument.
