This order is made under section 4A(1) of the Misuse of Drugs Act 1975 on the advice and with the consent of the Executive Council.

This order is the Misuse of Drugs (Classification and Presumption of Supply—25B-NBOMe, 25C-NBOMe, and 25I-NBOMe) Order Commencement Order 2016.

2 Commencement of Misuse of Drugs (Classification and Presumption of Supply—25B-NBOMe, 25C-NBOMe, and 25I-NBOMe) Order 2016

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order brings the Misuse of Drugs (Classification and Presumption of Supply—25B-NBOMe, 25C-NBOMe, and 25I-NBOMe) Order 2016 into force on 22 December 2016. That order classifies 25B-NBOMe, 25C-NBOMe, and 25I-NBOMe as Class B controlled drugs and specifies the level at which possession of those substances is presumed to be for supply.

Under section 4A(2) of the Misuse of Drugs Act 1975, this commencement order may be made only after the Misuse of Drugs (Classification and Presumption of Supply—25B-NBOMe, 25C-NBOMe, and 25I-NBOMe) Order 2016 has been approved by resolution of the House of Representatives. The House of Representatives approved that order on 8 September 2016.
