Consumer Information Standards (Water Efficiency) Regulations 2017

These regulations are made under section 27 of the Fair Trading Act 1986—

(a)

on the advice and with the consent of the Executive Council; and

(b)

on the recommendation of the Minister of Consumer Affairs made in accordance with section 27(3) of that Act.

Regulations

1 Title

These regulations are the Consumer Information Standards (Water Efficiency) Regulations 2017.

2 Commencement

These regulations come into force on 1 October 2017.

3 Interpretation

In these regulations, unless the context otherwise requires,—

AS/NZS 2007.1 means the Australia/New Zealand Standard AS/NZS 2007.1:2005: Performance of household electrical appliances—Dishwashers—Part 1: Methods for measuring performance, energy and water consumption

AS/NZS 2007.2 means the Australia/New Zealand Standard AS/NZS 2007.2:2005: Performance of household electrical appliances—Dishwashers—Part 2: Energy efficiency labelling requirements

AS/NZS 2040.1 means the Australia/New Zealand Standard AS/NZS 2040.1:2005: Performance of household electrical appliances—Clothes washing machines—Part 1: Methods for measuring performance, energy and water consumption

AS/NZS 2040.2 means the Australia/New Zealand Standard AS/NZS 2040.2:2005: Performance of household electrical appliances—Clothes washing machines—Part 2: Energy efficiency labelling requirements

AS/NZS 6400:2016 means the Australia/New Zealand Standard AS/NZS 6400:2016: Water efficient products—Rating and labelling

clearly displayed means, in relation to water-using equipment, displayed in a way that is easy to read and clearly visible and attributable to that equipment

model means, in relation to water-using equipment, a range of items of the same type and brand as that equipment, where each item has the same water efficiency performance characteristics

rated capacity means, in relation to a dishwasher, the number of complete place settings, as defined in clause 1.4.8 of AS/NZS 2007.1, that the manufacturer claims can be cleaned and dried when loaded in accordance with the manufacturer’s instructions and clauses 4.3 and 5.2 of AS/NZS 2007.1

rated load capacity means, in relation to a clothes washing machine, the maximum mass of normally soiled cotton (to the nearest 0.5 kg) that the manufacturer claims can be treated by the clothes washing machine in accordance with the requirements of AS/NZS 2040.1

star rating means, in relation to water-using equipment, the number of stars to which that equipment is entitled, calculated in accordance with Schedule 2

stated wash programme means the wash programme used to determine water efficiency, being,—

(a)

in relation to a dishwasher, the programme, including all associated specific settings, nominated by the person commissioning the testing, used to wash a normally soiled load at rated capacity in accordance with clause 2.2.1 of AS/NZS 2007.2 with the exception of compliance with the performance criteria specified in that clause; and

(b)

in relation to a clothes washing machine, the programme, including all associated specific settings, nominated by the person commissioning the testing, used to wash a normally soiled cotton load at rated load capacity in accordance with clause 2.2.1 of AS/NZS 2040.2 with the exception of compliance with the performance criteria specified in that clause

water consumption means, in relation to water-using equipment, the water consumption of that equipment, calculated in accordance with Schedule 2

water-using equipment means the following equipment (within the meaning given to each in AS/NZS 6400:2016):

(a)

showers:

(b)

tap equipment:

(c)

lavatory equipment:

(d)

urinal equipment (except waterless urinals):

(e)

dishwashers:

(f)

clothes washing machines.

4 Transitional, savings, and related provisions

The transitional, savings, and related provisions set out in Schedule 1 have effect according to their terms.

5 Application

(1)

These regulations apply to water-using equipment, except where that equipment has been used by a person in New Zealand.

(2)

Equipment is not used by a person by reason only that the person acquired the equipment for the purpose of resupplying it in trade.

Consumer information standards for water efficiency

6 Consumer information standards for water efficiency

Regulations 7 to 13 and Schedules 2 to 4 are consumer information standards for the water-using equipment to which these regulations apply for the purposes of section 27 of the Fair Trading Act 1986.

Labelling of water-using equipment when supplied or physically displayed for supply

7 Labelling of water-using equipment with star rating of 1 or more stars

Water-using equipment that has a star rating of 1 or more stars must, when supplied or physically displayed for supply, have all of the following clearly displayed:

(a)

for packaged equipment, a label in the form required by Part 1 of Schedule 3 displayed on the packaging:

(b)

for unpackaged dishwashers or clothes washing machines, a label in the form required by Part 1 of Schedule 3 displayed in the manner required by Schedule 4:

(c)

for unpackaged showers, tap equipment, lavatory equipment, or urinal equipment, either—

(i)

a label in the form required by Part 1 of Schedule 3 displayed—

(A)

in the manner required by Schedule 4; or

(B)

in accordance with clause 2.5.2 of AS/NZS 6400:2016; or

(ii)

both of the following:

(A)

the words “water efficiency” together with the equipment’s star rating:

(B)

the words “water consumption” together with the equipment’s water consumption:

(d)

for showers and tap equipment, the intended water supply pressure (that is, mains pressure or low pressure).

8 Labelling of water-using equipment with star rating of zero stars

Water-using equipment that has a star rating of zero stars must, when supplied or physically displayed for supply, have all of the following clearly displayed:

(a)

for packaged equipment, a label in the form required by Part 2 of Schedule 3 displayed on the packaging:

(b)

for unpackaged dishwashers or clothes washing machines, a label in the form required by Part 2 of Schedule 3 displayed in the manner required by Schedule 4:

(c)

for unpackaged showers, tap equipment, lavatory equipment, or urinal equipment, either—

(i)

a label in the form required by Part 2 of Schedule 3 displayed—

(A)

in the manner required by Schedule 4; or

(B)

in accordance with clause 2.5.2 of AS/NZS 6400:2016; or

(ii)

all of the following:

(A)

the words “ZERO STAR RATED” in capital letters:

(B)

the words “NOT WATER EFFICIENT” in capital letters:

(C)

the words “In accordance with AS/NZS 6400:2016”.

9 Labelling of showers that are not star rated

Showers that are not star rated must, when supplied or physically displayed for supply, have all of the following clearly displayed:

(a)

for packaged showers, a label in the form required by Part 3 of Schedule 3 displayed on the packaging:

(b)

for unpackaged showers, either—

(i)

a label in the form required by Part 3 of Schedule 3 displayed—

(A)

in the manner required by Schedule 4; or

(B)

in accordance with clause 2.5.2 of AS/NZS 6400:2016; or

(ii)

all of the following:

(A)

the words “NOT STAR RATED” in capital letters:

(B)

the words “Fails low-flow performance tests”:

(C)

the words “In accordance with AS/NZS 6400:2016”.

10 Information labelling requirements

A label that is required to be displayed on water-using equipment by regulation 7, 8, or 9 must comply with the information labelling requirements in Schedule 2.

11 Additional information requirements for equipment requiring ancillary components to achieve stated star rating or water consumption

Showers, tap equipment, lavatory equipment, or urinal equipment that requires 1 or more ancillary components to achieve its stated star rating or water consumption must, when supplied or physically displayed for supply, have all of the following information clearly displayed:

(a)

the required ancillary components:

(b)

any assembly or installation instructions for those components:

(c)

the advice that those components are required for the showers, tap equipment, lavatory equipment, or urinal equipment to achieve the equipment’s stated star rating or water consumption.

12 Labelling requirements satisfied by compliance with AS/NZS 6400:2016

Water-using equipment that is labelled in compliance with AS/NZS 6400:2016 is to be treated as complying with regulations 7 to 11.

Information requirements when offering to supply on Internet

13 Information requirements when offering to supply on Internet

(1)

An offer, on an Internet site, to supply water-using equipment must have 1 of the following clearly displayed:

(a)

a reproduction of the label that would be required to be displayed by regulation 7, 8, or 9 if the water-using equipment were supplied or physically displayed for supply:

(b)

for water-using equipment that has a star rating of zero stars, all of the following:

(i)

the words “ZERO STAR RATED” in capital letters:

(ii)

the words “NOT WATER EFFICIENT” in capital letters:

(iii)

the words “In accordance with AS/NZS 6400:2016”:

(c)

for water-using equipment that has a star rating of 1 or more stars, all of the following:

(i)

the words “water efficiency” together with the equipment’s star rating:

(ii)

the words “water consumption” together with the equipment’s water consumption:

(iii)

in the case of a shower or tap equipment, the intended water supply pressure (that is, mains pressure or low pressure):

(iv)

in the case of a dishwasher, the rated capacity before the words “place settings”:

(v)

in the case of a clothes washing machine, the rated load capacity before the letters “kg”:

(d)

for showers that are not star rated, all of the following:

(i)

the words “NOT STAR RATED” in capital letters:

(ii)

the words “Fails low-flow performance tests”:

(iii)

the words “In accordance with AS/NZS 6400:2016”.

(2)

An offer, on an Internet site, to supply dishwashers or clothes washing machines must also have the stated wash programme clearly displayed.

(3)

A label referred to in subclause (1)(a) may be scaled up or down on the Internet site, provided it is still easy to read and clearly visible.

Revocation

14 Revocation

The Consumer Information Standards (Water Efficiency) Regulations 2010 (SR 2010/81) are revoked on the close of 30 September 2019.

Schedule 1 Transitional, savings, and related provisions

Part 1 Provision relating to these regulations as made

1 Application of regulations during transitional period

During the period starting on 1 October 2017 and ending on the close of 30 September 2019,—

(a)

a person must comply with either the Consumer Information Standards (Water Efficiency) Regulations 2010 or these regulations; and

(b)

compliance with either set of regulations is compliance with the other set of regulations.

Schedule 2 Information labelling requirements for water-using equipment

Showers
Brand name

Identify the model’s brand name, for example, the trading name of the model’s manufacturer or other identifier.

Model identifier

Identify the model, for example, by a model number or another identifier.

Water consumption

State the model’s water consumption, calculated in accordance with clause 3.4.2 of AS/NZS 6400:2016.

Star rating

State the model’s star rating, or that the model is not star rated, calculated in accordance with,—

(a)

for high pressure showers, clause 3.4.3 of AS/NZS 6400:2016; and

(b)

for low pressure showers, clause 3.4.4 of AS/NZS 6400:2016.

Tap equipment
Brand name

Identify the model’s brand name, for example, the trading name of the model’s manufacturer or other identifier.

Model identifier

Identify the model, for example, by a model number or another identifier.

Water consumption

State the model’s water consumption, calculated in accordance with clause 4.4.2 of AS/NZS 6400:2016.

Star rating

State the model’s star rating, calculated in accordance with clause 4.4.3 of AS/NZS 6400:2016.

Lavatory equipment
Brand name

Identify the model’s brand name, for example, the trading name of the model’s manufacturer or other identifier.

Model identifier

Identify the model, for example, by a model number or another identifier.

Water consumption

State the model’s water consumption, calculated in accordance with clause 6.4.2 of AS/NZS 6400:2016.

Star rating

State the model’s star rating, calculated in accordance with clause 6.4.3 of AS/NZS 6400:2016, except that lavatory equipment with a flush figure that is higher than is required to have a 1 star rating must be given a rating of zero stars.

Urinal equipment
Brand name

Identify the model’s brand name, for example, the trading name of the model’s manufacturer or other identifier.

Model identifier

Identify the model, for example, by a model number or another identifier.

Water consumption

State the model’s water consumption, calculated in accordance with clause 7.4.3 of AS/NZS 6400:2016.

Star rating

State the model’s star rating, calculated in accordance with clause 7.4.4 of AS/NZS 6400:2016.

Dishwashers
Brand name

Identify the model’s brand name, for example, the trading name of the model’s manufacturer or other identifier.

Model identifier

Identify the model, for example, by a model number or another identifier.

Water consumption

State the model’s water consumption, calculated in accordance with clause 8.2.2 of AS/NZS 6400:2016.

Star rating

State the model’s star rating, calculated in accordance with clause 8.2.3 of AS/NZS 6400:2016.

Rated capacity

State the model’s rated capacity before the words “place settings” (unless a combined label is used in accordance with clause 8.3.2.2 of AS/NZS 6400:2016).

Stated wash programme

Identify the wash programme used to determine the water efficiency of the dishwasher at its rated capacity (unless a combined label is used in accordance with clause 8.3.2.2 of AS/NZS 6400:2016).

Clothes washing machines
Brand name

Identify the model’s brand name, for example, the trading name of the model’s manufacturer or other identifier.

Model identifier

Identify the model, for example, by a model number or another identifier.

Water consumption

State the model’s water consumption, calculated in accordance with clause 9.2.2 of AS/NZS 6400:2016.

Star rating

State the model’s star rating, calculated in accordance with clause 9.2.3 of AS/NZS 6400:2016, except that—

(a)

the water extraction index requirements in clause 3.4 of AS/NZS 2040.2 are optional; and

(b)

a clothes washing machine with a water consumption figure that is higher than is required to have a 1 star rating must be given a rating of zero stars.

Rated load capacity

State the model’s rated load capacity before the letters “kg” (unless a combined label is used in accordance with clause 9.4.2.2 of AS/NZS 6400:2016).

Stated wash programme

Identify the wash programme used to determine the water efficiency of the clothes washing machine at its rated load capacity (unless a combined label is used in accordance with clause 9.4.2.2 of AS/NZS 6400:2016).

Schedule 3 Labels for water-using equipment

Part 1 Labels for water-using equipment with star rating of 1 or more stars

1 Showers

(1)

Labels for showers with a star rating of 1 or more stars must comply with clause 3.5.4.1 or 3.5.4.2 of AS/NZS 6400:2016 (including being in the format and dimensions indicated in figure 3.5 or 3.6 of AS/NZS 6400:2016).

(2)

However,—

(a)

the number of stars in the shaded portion of the background arch must be equal to the model’s star rating:

(b)

the dimensions and font sizes within a section, but not the height of a section, may be adjusted to the extent reasonably necessary to accommodate the variations illustrated in paragraph (e) or (f):

(c)

a label may be scaled proportionally in accordance with clause 2.5.3.1 of AS/NZS 6400:2016 if the full-size label does not fit on the equipment or its packaging:

(d)

unless a monochrome label is permitted to be used by clause 2.5.4.2 of AS/NZS 2400:2016,—

(i)

the portion of the background arch directly behind the number of stars equal to the model’s star rating, and the section containing the litres per minute information, must be shaded medium blue (Pantone 299); and

(ii)

the bottom section containing the standard, brand, and model must be shaded light blue (Pantone 290); and

(iii)

in respect of figure 3.6 (as varied by paragraph (f)), the section directly below the Internet site address must be shaded light blue (Pantone 290):

(e)

figure 3.5 is varied as illustrated:

2 Tap equipment

(1)

Labels for tap equipment with a star rating of 1 or more stars must comply with clause 4.5.4.1 or 4.5.4.2 of AS/NZS 6400:2016 (including being in the format and dimensions indicated in figure 4.3 or 4.4 of AS/NZS 6400:2016).

(2)

However,—

(a)

the number of stars in the shaded portion of the background arch must be equal to the model’s star rating:

(b)

the dimensions and font sizes within a section, but not the height of a section, may be adjusted to the extent reasonably necessary to accommodate the variations illustrated in paragraph (e) or (f):

(c)

a label may be scaled proportionally in accordance with clause 2.5.3.1 of AS/NZS 6400:2016 if the full-size label does not fit on the equipment or its packaging:

(d)

unless a monochrome label is permitted to be used by clause 2.5.4.2 of AS/NZS 6400:2016,—

(i)

the portion of the background arch directly behind the number of stars equal to the model’s star rating, and the section containing the litres per minute information, must be shaded medium blue (Pantone 299); and

(ii)

the bottom section containing the standard, brand, and model must be shaded light blue (Pantone 290); and

in respect of figure 4.4 (as varied by paragraph (f)), the section directly below the Internet site address must be shaded light blue (Pantone 290):

3 Lavatory equipment

(1)

Labels for lavatory equipment with a star rating of 1 or more stars must comply with clause 6.5.2 of AS/NZS 6400:2016 (including being in the format and dimensions indicated in figure 6.4 of AS/NZS 6400:2016).

(2)

However,—

(a)

the number of stars in the shaded portion of the background arch must be equal to the model’s star rating:

(b)

the dimensions and font sizes within a section, but not the height of a section, may be adjusted to the extent reasonably necessary to accommodate the variations illustrated in paragraph (e):

(c)

a label may be scaled proportionally in accordance with clause 2.5.3.1 of AS/NZS 6400:2016 if the full-size label does not fit on the equipment or its packaging:

(d)

unless a monochrome label is permitted to be used by clause 2.5.4.2 of AS/NZS 6400:2016,—

(i)

the portion of the background arch directly behind the number of stars equal to the model’s star rating, and the section containing the litres average flush information, must be shaded medium blue (Pantone 299); and

4 Urinal equipment

(1)

Labels for urinal equipment with a star rating of 1 or more stars must comply with clause 7.5.2.1 of AS/NZS 6400:2016 (including being in the format and dimensions indicated in figure 7.3 of AS/NZS 6400:2016).

(2)

However,—

(a)

the number of stars in the shaded portion of the background arch must be equal to the model’s star rating:

(b)

the dimensions and font sizes within a section, but not the height of a section, may be adjusted to the extent reasonably necessary to accommodate the variations illustrated in paragraph (e):

(c)

a label may be scaled proportionally in accordance with clause 2.5.3.1 of AS/NZS 6400:2016 if the full-size label does not fit on the equipment or its packaging:

(d)

unless a monochrome label is permitted to be used by clause 2.5.4.2 of AS/NZS 6400:2016,—

(i)

the portion of the background arch directly behind the number of stars equal to the model’s star rating, and the section containing the litres per flush per stall information, must be shaded medium blue (Pantone 299); and

5 Dishwashers

(1)

Labels for dishwashers with a star rating of 1 or more stars must comply with clause 8.3.2.1 or 8.3.2.2 of AS/NZS 6400:2016 (including being in the format and dimensions indicated in figure 8.2 or 8.3 of AS/NZS 6400:2016).

(2)

However,—

(a)

the number of stars or half stars in the shaded portion of the background arch must be equal to the model’s star rating:

(b)

the dimensions and font sizes within a section, but not the height of a section, may be adjusted to the extent reasonably necessary to accommodate the variations illustrated in paragraph (e) or (f):

(c)

the portion of the background arch directly behind the number of stars or half stars equal to the model’s star rating, and the section containing the litres per wash information, must be shaded medium blue (Pantone 299):

6 Clothes washing machines

(1)

Labels for clothes washing machines with a star rating of 1 or more stars must comply with clause 9.4.2.1 or 9.4.2.2 of AS/NZS 6400:2016 (including being in the format and dimensions indicated in figure 9.2 or 9.3 of AS/NZS 6400:2016).

(2)

However,—

(a)

the number of stars or half stars in the shaded portion of the background arch must be equal to the model’s star rating:

(b)

the dimensions and font sizes within a section, but not the height of a section, may be adjusted to the extent reasonably necessary to accommodate the variations illustrated in paragraph (e) or (f):

(c)

the portion of the background arch directly behind the number of stars or half stars equal to the model’s star rating, and the section containing the litres per wash information, must be shaded medium blue (Pantone 299):

(d)

the bottom section containing the standard, brand, and model must be shaded light blue (Pantone 290):

7 Showers

(1)

Labels for showers with a star rating of zero stars must comply with clause 3.5.4.5 of AS/NZS 6400:2016 (including being in the format and dimensions indicated in figure 3.9 of AS/NZS 6400:2016).

(2)

However,—

(a)

the dimensions and font sizes within a section, but not the height of a section, may be adjusted to the extent reasonably necessary to accommodate the variations illustrated in paragraph (d):

(b)

a label may be scaled proportionally in accordance with clause 2.5.3.1 of AS/NZS 6400:2016 if the full-size label does not fit on the equipment or its packaging:

(c)

unless a monochrome label is permitted to be used by clause 2.5.4.2 of AS/NZS 6400:2016,—

(i)

the section containing the litres per minute information must be shaded medium blue (Pantone 299); and

(ii)

the bottom section containing the standard, brand, and model must be shaded light blue (Pantone 290); and

(iii)

the section directly below the Internet site address must be shaded red (Pantone Warm Red); and

(iv)

the words “ZERO STAR RATED” in the arch must be red (Pantone Warm Red):

(d)

figure 3.9 is varied as illustrated:

8 Tap equipment

(1)

Labels for tap equipment with a star rating of zero stars must comply with clause 4.5.4.3 of AS/NZS 6400:2016 (including being in the format and dimensions indicated in figure 4.5 of AS/NZS 6400:2016).

(2)

However,—

(a)

the dimensions and font sizes within a section, but not the height of a section, may be adjusted to the extent reasonably necessary to accommodate the variations illustrated in paragraph (d):

(b)

a label may be scaled proportionally in accordance with clause 2.5.3.1 of AS/NZS 6400:2016 if the full-size label does not fit on the equipment or its packaging:

(c)

unless a monochrome label is permitted to be used by clause 2.5.4.2 of AS/NZS 6400:2016,—

(i)

the section containing the litres per minute information must be shaded medium blue (Pantone 299); and

(ii)

the bottom section containing the standard, brand, and model must be shaded light blue (Pantone 290); and

9 Lavatory equipment

(1)

Labels for lavatory equipment with a star rating of zero stars must be in the format and dimensions indicated in figure 6.4 of AS/NZS 6400:2016.

(2)

However,—

(a)

the dimensions and font sizes within a section, but not the height of a section, may be adjusted to the extent reasonably necessary to accommodate the variations illustrated in paragraph (d):

(b)

a label may be scaled proportionally in accordance with clause 2.5.3.1 of AS/NZS 6400:2016 if the full-size label does not fit on the equipment or its packaging:

(c)

unless a monochrome label is permitted to be used by clause 2.5.4.2 of AS/NZS 6400:2016,—

(i)

the section containing the litres average flush information must be shaded medium blue (Pantone 299); and

(ii)

the bottom section containing the standard, brand, and model must be shaded light blue (Pantone 290); and

(iii)

the section directly below the Internet site address must be shaded red (Pantone Warm Red); and

(iv)

the words “ZERO STAR RATED” in the arch must be red (Pantone Warm Red):

(d)

10 Urinal equipment

(1)

Labels for urinal equipment with a star rating of zero stars must comply with clause 7.5.2.2 of AS/NZS 6400:2016 (including being in the format and dimensions indicated in figure 7.4 of AS/NZS 6400:2016).

(2)

However,—

(a)

the dimensions and font sizes within a section, but not the height of a section, may be adjusted to the extent reasonably necessary to accommodate the variations illustrated in paragraph (d):

(b)

a label may be scaled proportionally in accordance with clause 2.5.3.1 of AS/NZS 6400:2016 if the full-size label does not fit on the equipment or its packaging:

(c)

13 Showers

(1)

Labels for showers that are not star rated must comply with clause 3.5.4.3 or 3.5.4.4 of AS/NZS 6400:2016 (including being in the format and dimensions indicated in figure 3.7 or 3.8 of AS/NZS 6400:2016).

(2)

However,—

(a)

the dimensions and font sizes within a section, but not the height of a section, may be adjusted to the extent reasonably necessary to accommodate the variations illustrated in paragraph (d) or (e):

(b)

a label may be scaled proportionally in accordance with clause 2.5.3.1 of AS/NZS 6400:2016 if the full-size label does not fit on the equipment or its packaging:

(c)

1 Showers

The label must be—

on both sides of a swing tag that is affixed to the shower; or

2 Tap equipment

The label must be—

(a)

affixed to the tap equipment; or

(b)

on both sides of a swing tag that is affixed to the tap equipment; or

(c)

placed adjacent to the tap equipment on any display for the tap equipment.

3 Lavatory equipment

The label must be—

(a)

affixed to the lavatory equipment; or

(b)

on both sides of a swing tag that is affixed to the lavatory equipment; or

(c)

placed adjacent to the lavatory equipment on any display for the equipment.

4 Urinal equipment

The label must be—

(a)

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 1 October 2017, prescribe consumer information standards for showers, tap equipment, lavatory equipment, urinal equipment, dishwashers, and clothes washing machines (the equipment) for the purposes of the Fair Trading Act 1986 (the Act).

These regulations replace the Consumer Information Standards (Water Efficiency) Regulations 2010 (the 2010 regulations). The 2010 regulations prescribed consumer information standards for the equipment by reference to Australia/New Zealand Standard AS/NZS 6400:2005 (with some variations). That standard has now been updated and replaced with Australia/New Zealand Standard AS/NZS 6400:2016, and these regulations prescribe consumer information standards for the equipment by reference to that new standard (with some variations).

These regulations apply to equipment that has not been used by a person in New Zealand.

These regulations require the labelling of equipment when it is supplied or physically displayed for supply. The labelling requirements depend on whether the equipment is packaged or unpackaged. Any ancillary component necessary to achieve the water efficiency of the equipment must be identified, along with assembly or installation instructions, when the equipment is supplied. These regulations also require that offers to supply equipment on an Internet site must contain similar information about water efficiency.

A person commits an offence under the Act if he or she supplies, offers to supply, or advertises to supply the equipment to which these regulations apply, unless that person complies with the consumer information standards set out in these regulations.

As a transitional measure, during the period beginning on 1 October 2017 (when these regulations come into force) and ending on the close of 30 September 2019 (when the 2010 regulations are revoked), a person may comply with either set of regulations.
