These regulations are made under section 167 of the Land Transport Act 1998 on the advice and with the consent of the Executive Council.
These regulations are the Transport Services Licensing Amendment Regulations (No 2) 2017.
These regulations come into force on 1 October 2017.
These regulations amend the Transport Services Licensing Regulations 1989 (the principal regulations).

In regulation 2, definition of Act, replace “Transport Services Licensing Act 1989” with “Land Transport Act 1998”.

In regulation 2, revoke the definitions of Small Passenger Service Rules and Vehicle Recovery Service Rules.
In regulation 7(2), replace “the Land Transport Act 1988” with “the Act”.

In regulation 9, replace “For the purposes of clause 5 of Part 1 of Schedule 1 of the Act, the following services are exempt services” with “The following services are exempted from being transport services for the purposes of Parts 4A and 6A of the Act”.

In Schedule 1, revoke the item relating to section 30P(2) of the Land Transport Act 1998.

These regulations, which come into force on 1 October 2017, amend the Transport Services Licensing Regulations 1989.
Regulation 4 updates the list of definitions in regulation 2 and regulations 5 and 6 make consequential amendments to regulations 7 and 9.
Regulation 7 amends Schedule 1. The amendments are consequential on the introduction of a new regulatory system for small passenger services.
The Ministry of Transport produced a regulatory impact statement on 15 March 2016 relating to the future framework for small passenger services to help inform the decisions taken by the Government relating to the contents of this instrument.
