Fisheries (Notification of Tāngata Kaitiaki/Tiaki for Area/Rohe Moana of Ngāti Wakarara and Ngāti Hau) Notice 2017

Pursuant to regulation 9 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, the Minister for Primary Industries gives the following notice.

Notice

1 Title

This notice is the Fisheries (Notification of Tāngata Kaitiaki/Tiaki for Area/Rohe Moana of Ngāti Wakarara and Ngāti Hau) Notice 2017.

2 Commencement

This notice comes into force on the day after the date of its notification in the Gazette.

3 Customary food gathering area/rohe moana

This notice applies to a customary food gathering area/rohe moana in the New Zealand fisheries waters (except South Island fisheries waters) within the following lines:

(a)

from the starting point near Mawhai Point at 38°10.600′S and 178°21.241′E; then

(b)

by a straight line due east to a point offshore at 38°10.600′S and 178°27.500′E; then

(c)

proceeding in a generally southerly direction by a line, each point of which is approximately 5 nautical miles from the mean high-water mark of the North Island east coast to a point offshore at 38°17.330′S and 178°27.100′E; then

(d)

by a line proceeding due west to a point at 38°17.330′S and 178°21.122′E near Marau Point; then

(e)

by a line proceeding in a generally northerly direction along the mean high-water mark back to the starting point.

4 Tangata whenua

The tangata whenua of the area/rohe moana are Ngāti Wakarara and Ngāti Hau.

5 Appointments

(1)

The Minister for Primary Industries has appointed the following people as Tāngata Kaitiaki/Tiaki for the area/rohe moana:

Nicola Searancke.

(2)

The appointments took effect on 4 September 2017.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice is made under the Fisheries (Kaimoana Customary Fishing) Regulations 1998 (the regulations). It comes into force on the day after the date of its notification in the Gazette.

The notice relates to a customary food gathering area/rohe moana of the tangata whenua represented by Ngāti Wakarara and Ngāti Hau. The area/rohe moana is an area from Mawhai Point to Marau Point on the East Cape, and extends approximately 5 nautical miles offshore.

Notice is given of the appointment of 2 Tāngata Kaitiaki/Tiaki for the area/rohe moana. The Minister for Primary Industries made the appointment at the request of Ngāti Wakarara and Ngāti Hau.

The powers of Tāngata Kaitiaki/Tiaki are set out in the regulations.
