Health Entitlement Cards Amendment Regulations 2018

These regulations are made under section 92 of the New Zealand Public Health and Disability Act 2000 and section 132A of the Social Security Act 1964 on the advice and with the consent of the Executive Council.

Regulations

1 Title

These regulations are the Health Entitlement Cards Amendment Regulations 2018.

2 Commencement

(1)

These regulations come into force on 1 April 2018.

(2)

However, regulations 5 and 6 and the cross-heading above regulation 5 come into force on 1 July 2018.

3 Principal regulations

These regulations amend the Health Entitlement Cards Regulations 1993 (the principal regulations).

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations amend the Health Entitlement Cards Regulations 1993 (the principal regulations) to raise, on 1 April 2018, and again on 1 July 2018, the income entitlement thresholds that are used to determine a person’s eligibility for a community services card.

The amendments on 1 April 2018 reflect an increase of 1.36% in the New Zealand Consumers Price Index from the December 2016 quarter to the December 2017 quarter (calculated for all quarters using the New Zealand Consumers Price Index (All Groups), excluding cigarettes and other tobacco products). These amendments also raise the income entitlement thresholds further on 1 April 2018 to ensure that current recipients of New Zealand superannuation do not lose eligibility for a community services card (under regulation 8(1)(e) and (5A) of the principal regulations) as a result of the increase to the rates of New Zealand superannuation under the Social Security (Rates of Benefits and Allowances) Order 2018.

The amendments on 1 July 2018 ensure that no person loses eligibility for a community services card due to the increase to Family Tax Credits on 1 July 2018 under the Families Package (Income Tax and Benefits) Act 2017. These amendments also adjust references to reflect amendments made by that Act.
