Joint Family Homes Amendment Regulations 2018

These regulations are made under section 26 of the Joint Family Homes Act 1964 on the advice and with the consent of the Executive Council.

Regulations

1 Title

These regulations are the Joint Family Homes Amendment Regulations 2018.

2 Commencement

These regulations come into force on 12 November 2018.

3 Principal regulations

These regulations amend the Joint Family Homes Regulations 1965 (the principal regulations).

4 Regulation 3A amended (Application to register other land as joint family home)

Revoke regulation 3A(2).

5 Regulation 4 amended

Replace regulation 4(4) with:

If an application relates to only part of the land recorded in a record of title, the Registrar, before registering the settlement in respect of the land, must require the registered proprietor to apply for a new record of title for that part, and section 224 of the Land Transfer Act 2017 applies to the application for that record of title.

6 Regulation 5A amended (Electronic lodgement of applications under section 5 or 12A of Act)

In regulation 5A(1), replace “Land Transfer (Computer Registers and Electronic Lodgement) Amendment Act 2002” with “Land Transfer Act 2017”.

7 Regulation 14 amended

In regulation 14, replace “a new certificate of title for that part, and the provisions of section 167 of the Land Transfer Act 1952 shall apply to the application for that certificate” with “a new record of title for that part, and section 224 of the Land Transfer Act 2017 applies to the application for that record of title”.

8 Schedule 1 amended

(1)

In Schedule 1, form 2, delete “at the District Land Registry Office at [specify]”.

(2)

In Schedule 1, forms 2 to 9, replace “District Land Registrar” with “Registrar-General of Land”.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations amend the Joint Family Homes Regulations 1965 (the principal regulations). The amendments commence on 12 November 2018, the date on which the Land Transfer Act 2017 commences.

The principal regulations are consequentially amended to fit with the Land Transfer Act 2017.
