These regulations are made under section 92 of the New Zealand Public Health and Disability Act 2000 and section 132A of the Social Security Act 1964 on the advice and with the consent of the Executive Council.

Regulations

1 Title

These regulations are the Health Entitlement Cards Amendment Regulations (No 2) 2018.

2 Commencement

These regulations come into force on 1 December 2018.

3 Principal regulations

These regulations amend the Health Entitlement Cards Regulations 1993 (the principal regulations).

4 Regulation 2 amended (Interpretation)

In regulation 2(1), insert in their appropriate alphabetical order:

social housing has the meaning given in section 2(1) of the Housing Restructuring and Tenancy Matters Act 1992

tenant has the meaning given in section 2(1) of the Housing Restructuring and Tenancy Matters Act 1992

5 Regulation 5 amended (Commencement dates and expiry dates of community services cards)

In regulation 5(2)(a), replace “regulation 8(1)(a) or regulation 8(1)(b)” with “regulation 8(1)(a), (ab), (b), or (ba)”.

6 Regulation 8 amended (Eligibility for community services cards)

After regulation 8(1)(a)(vii), insert:

an accommodation supplement payable under section 61EA of the Social Security Act 1964:

a tenant of social housing:

7 Regulation 12 amended (Authorised uses of community services cards)

In regulation 12(b)(ii)(A), delete “, other than treatment paid for (in whole or in part) by the Accident Compensation Corporation or an insurer under the Accident Insurance Act 1998”.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 1 December 2018, amend the Health Entitlement Cards Regulations 1993. The amendments extend eligibility for community services cards to those receiving accommodation supplements and to social housing tenants. Dates of commencement of the cards are specified, as well as the commencement date for cards for those eligible under regulation 8(1)(ab), which relates to persons receiving some types of compensation under the Veterans’ Support Act 2014. The regulations also enable community services cardholders to use the cards as evidence that they and their dependent children are eligible to pay lower co-payments for ACC-funded general practitioner visits.
