Financial Markets Conduct (Shares in Investment Companies) Designation Amendment Notice (No 2) 2018

Pursuant to section 562 of the Financial Markets Conduct Act 2013, the Financial Markets Authority, having complied with the requirements set out in section 563 of that Act, gives the following notice.

Notice

1 Title

This notice is the Financial Markets Conduct (Shares in Investment Companies) Designation Amendment Notice (No 2) 2018.

2 Commencement

This notice comes into force on 1 January 2019.

4 Clause 3 amended (Interpretation)

In clause 3(1), replace the definition of NZX Main Board with:

NZX Main Board means the financial product market operated by NZX Limited under that name

Dated at Wellington this 12th day of December 2018.

Nick Kynoch,
General Counsel.

Statement of reasons

This notice, which comes into force on 1 January 2019, amends the Financial Markets Conduct (Shares in Investment Companies) Designation Notice 2017 (the principal notice). This notice replaces the definition of NZX Main Board in the principal notice with a new definition that refers to the financial product market operated by NZX Limited, rather than the equity securities market operated by NZX Limited. This aligns the definition with NZX Limited’s updated listing rules, which take effect on 1 January 2019.

The Financial Markets Authority (the FMA), having complied with the requirements set out in section 563 of the Financial Markets Conduct Act 2013, considers it appropriate to amend the principal notice to ensure consistency between the notice and NZX Limited’s listing rules. The FMA is satisfied that the amendment does not change the effect of the principal notice.

Issued under the authority of the Legislation Act 2012.

Date of notification in Gazette: 14 December 2018.

This notice is administered by the Financial Markets Authority.
