Fisheries (Notification of Tāngata Kaitiaki/Tiaki for Area/Rohe Moana of Ngāti Takapari, Te Waiariki, and Ngāti Korora) Notice 2019

Pursuant to regulation 9 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, the Minister of Fisheries gives the following notice.

1 Title

This notice is the Fisheries (Notification of Tāngata Kaitiaki/Tiaki for Area/Rohe Moana of Ngāti Takapari, Te Waiariki, and Ngāti Korora) Notice 2019.

2 Commencement

This notice comes into force on the 28th day after the date of its notification in the Gazette.

3 Customary food gathering area/rohe moana

(1)

This notice applies to a customary food gathering area/rohe moana in the New Zealand fisheries waters (except South Island fisheries waters) within the following lines (but subject to subclause (2)):

(a)

from the starting point at 35°35.775′S and 174°32.227′E near Middle Gable; then

(b)

by a straight line due east until intersecting with the outer exclusive economic zone boundary at approximately 35°35.775′S and 178°11.077′W; then

(c)

proceeding in a generally south-easterly direction to a point along the outer exclusive economic zone boundary at approximately 35°40.337′S and 178°6.571′W; then

(d)

by a straight line due west to a point at 35°40.337′S and 174°30.467′E near Horahora; then

(e)

proceeding in a generally northerly direction along the mean high-water mark until the mouth of the Horahora River; then

(f)

proceeding in a generally westerly direction along the southern bank of the Horahora River to a point at 35°40.081′S and 174°27.263′E; then

(g)

proceeding in a straight line across the river to a point on the northern riverbank at 35°40.070′S and 174°27.263′E; then

(h)

proceeding in a generally easterly direction along the northern bank of the Horahora River to the mean high-water mark of the coastline; then

(i)

proceeding in a generally northerly direction along the mean high-water mark until the mouth of the Ngunguru River; then

(j)

proceeding in a generally westerly direction along the southern bank of the Ngunguru River to a point at 35°38.714′S and 174°25.217′E; then

(k)

proceeding in a straight line across the river to a point on the northern riverbank at 35°38.714′S and 174°25.207′E; then

(l)

proceeding in a generally easterly direction along the northern bank of the Ngunguru River to the mean high-water mark of the coastline; then

(m)

by a line proceeding in a generally northerly direction along the mean high-water mark back to the starting point.

(2)

The customary food gathering area/rohe moana does not include any areas that overlap with the customary food gathering area/rohe moana defined by clause 3 of the Fisheries (Notification of Tāngata Kaitiaki/Tiaki for Area/Rohe Moana of Te Whanau a Kauaetangohia Hapū) Notice 2016.

4 Tangata whenua

The tangata whenua of the area/rohe moana are Ngāti Takapari, Te Waiariki, and Ngāti Korora.

5 Appointments

The Minister of Fisheries has appointed the following people as Tāngata Kaitiaki/Tiaki for the area/rohe moana:

The appointments took effect on 9 November 2018.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice is made under the Fisheries (Kaimoana Customary Fishing) Regulations 1998 (the regulations). It comes into force on the 28th day after the date of its notification in the Gazette.

The notice relates to a customary food gathering area/rohe moana of the tangata whenua Ngāti Takapari, Te Waiariki, and Ngāti Korora. The area/rohe moana is from Te Ihu o Manaia (Middle Gable) to Paparoa/Horahora, on the east coast of Northland, north of Whangārei.

Notice is given of the appointment of 5 Tāngata Kaitiaki/Tiaki for the area/rohe moana. The Minister of Fisheries confirmed the appointments at the request of Ngāti Takapari, Te Waiariki, and Ngāti Korora.

The powers of Tāngata Kaitiaki/Tiaki are set out in the regulations.
