These regulations are made under section 303 of the Education Act 1989 on the advice and with the consent of the Executive Council.

Regulations

1 Title

These regulations are the Student Allowances Amendment Regulations (No 2) 2019.

2 Commencement

These regulations come into force on 1 July 2019.

3 Principal regulations

These regulations amend the Student Allowances Regulations 1998 (the principal regulations).

4 Regulation 5 amended (Reassessment of parental income)

In regulation 5(1), replace “$55,027.96” with “the amount specified in clause 3(3) of Schedule 2 multiplied by 52”.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 1 July 2019, amend the Student Allowances Regulations 1998 to correct a figure in regulation 5(1).

The parental income threshold (weekly amount) specified in clause 3(3) of Schedule 2 was increased on 1 April 2019 to reflect the increase in the Consumer Price Index (All Groups) for the year ending 31 March 2019. However, the figure in regulation 5(1), which should express the parental income threshold as an annual amount, was not changed at the same time so is incorrect.

Regulation 5(1), as amended, provides that the parental income threshold (annual amount) is the amount specified in clause 3(3) of Schedule 2 multiplied by 52. This formulation corrects the error made on 1 April 2019 and makes the relationship between the two provisions more transparent. The formulation also removes the possibility of the error recurring in the future because it will no longer be necessary to amend regulation 5(1) each time the parental income threshold is increased.
