Fisheries (Notification of Tāngata Kaitiaki/Tiaki for Area/Rohe Moana of Ngāti Kaihoro, Ngāti Torotoroa, Ngāti Kuri ki Rawhitiroa, Tahu Kai, and Te Popoto) Notice 2019

Pursuant to regulation 9 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, the Minister of Fisheries gives the following notice.

1 Title

This notice is the Fisheries (Notification of Tāngata Kaitiaki/Tiaki for Area/Rohe Moana of Ngāti Kaihoro, Ngāti Torotoroa, Ngāti Kuri ki Rawhitiroa, Tahu Kai, and Te Popoto) Notice 2019.

2 Commencement

This notice comes into force on the day after the date of its notification in the Gazette.

3 Customary food gathering area/rohe moana

This notice applies to a customary food gathering area/rohe moana in the New Zealand fisheries waters enclosed by a line—

(a)

commencing at a point on the northern shore of the mouth of the Waiatua Stream at 35°16.856′S and 173°9.146′E; then

(b)

proceeding along the mean high-water mark in a generally south-easterly, then easterly then northerly direction to a point on the western shore of the Herekino River at 35°16.201′S and 173°11.576′E; then

(c)

proceeding east to the eastern shore of the Herekino River at 35°16.196′S and 173°11.978′E; then

(d)

proceeding along the mean high-water mark in a generally south-westerly, then south-easterly direction to Koekoe Point at 35°20.361′S and 173°11.266′E; then

(e)

proceeding due west for 200 nautical miles to the exclusive economic zone boundary; then

(f)

proceeding in a generally northerly direction, every point of which is 200 nautical miles from the mean high water mark, to a point on the exclusive economic zone boundary that is 200 nautical miles due west of the starting point at the mouth of the Waiatua Stream at 35°16.856′S and 173°9.146′E; then

(g)

proceeding due east to the starting point.

4 Tangata whenua

The tangata whenua of the area/rohe moana are Ngāti Kaihoro, Ngāti Torotoroa, Ngāti Kuri ki Rawhitiroa, Tahu Kai, and Te Popoto.

5 New appointments

The Minister for Fisheries has appointed the following people as Tāngata Kaitiaki/Tiaki for the area/rohe moana:

The appointments took effect on 7 November 2018.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice is made under the Fisheries (Kaimoana Customary Fishing) Regulations 1998 (the regulations). It comes into force on the day after the date of its notification in the Gazette.

The notice relates to a customary food gathering area/rohe moana of the tangata whenua represented by Ngāti Kaihoro, Ngāti Torotoroa, Ngāti Kuri ki Rawhitiroa, Tahu Kai, and Te Popoto. The area/rohe moana is for an area of Northland between Te Rerenga and Te Piko, including Herekino Harbour, and extending seaward to the 200-mile limit of New Zealand fisheries waters.

Notice is given of the appointment of 4 Tāngata Kaitiaki/Tiaki for the area/rohe moana. The Minister of Fisheries made the appointments at the request of Ngāti Kaihoro, Ngāti Torotoroa, Ngāti Kuri ki Rawhitiroa, Tahu Kai, and Te Popoto.

The powers of Tāngata Kaitiaki/Tiaki are set out in the regulations.
