These regulations are made under section 140(1)(c) of the Hazardous Substances and New Organisms Act 1996

(a)

on the advice and with the consent of the Executive Council; and

(b)

on the recommendation of the Minister for the Environment made after consideration of the matters in section 140(2) of that Act and after complying with the requirements of section 141 of that Act.

Regulations

1 Title

These regulations are the Hazardous Substances and New Organisms (Organisms Prescribed as Not New Organisms) Amendment Regulations 2019.

2 Commencement

These regulations come into force on 15 September 2019.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 15 September 2019, amend the Hazardous Substances and New Organisms (Organisms Prescribed as Not New Organisms) Regulations 2009.

The regulations add 5 organisms to the schedule of organisms that are “not new” organisms for the purposes of the Hazardous Substances and New Organisms Act 1996.

The new classification will remove the need to apply for Environmental Protection Authority approval for importing, developing, field testing, or releasing those organisms.

Issued under the authority of the Legislation Act 2012.
