This order is made under section 96 of the Customs and Excise Act 2018—
(a)
on the advice and with the consent of the Executive Council; and
(b)
on the recommendation of the Minister of Customs made after being satisfied of the matter set out in section 96(5) of that Act.
Order
1 Title
This order is the Customs Import Prohibition (Goods Produced by Prison Labour) Order 2019.
2 Commencement
This order comes into force on 1 October 2019.
Order: confirmed, on 12 December 2020, by section 10(c) of the Subordinate Legislation Confirmation Act 2020 (2020 No 66).
3 Importation of goods produced by prison labour prohibited
The importation of the following goods is prohibited, excluding a bona fide gift made by a prisoner for the personal use of a private individual:
(a)
goods manufactured or produced wholly or in part by prison labour:
(b)
goods manufactured or produced wholly or in part within, or in connection with, any prison, jail, or penitentiary.
4 Importation of other goods connected with prisons prohibited
The importation of goods similar in character to those manufactured or produced in prisons, jails or penitentiaries is prohibited if the goods are—
(a)
sold or offered for sale by any person, firm, or corporation having a contract for the manufacture or production of such articles in such institutions (a prison contractor); or
(b)
sold or offered for sale by an agent of a prison contractor; or
(c)
originally purchased from or transferred by a prison contractor.

Explanatory note
This note is not part of the order, but is intended to indicate its general effect.
This order is made under the Customs and Excise Act 2018 (the Act) and prohibits the importation of goods produced by prison labour and some similar goods.
This order comes into force on 1 October 2019 and continues a prohibition in section 54(1) and Schedule 1 of the Customs and Excise Act 1996 (as saved by section 9 and clause 8 of Schedule 1 of the Act), which expires at the close of 30 September 2019.
This order is a confirmable instrument under section 47B of the Legislation Act 2012. It will be revoked at the close of 31 December 2020 unless earlier confirmed by an Act of Parliament. That stated time is the applicable deadline under section 47C(1)(b) of that Act.
