This order is made under sections 30A(1A), 30J(2), and 30K of the State Sector Act 1988 on the advice and with the consent of the Executive Council.

Order

1 Title

This order is the State Sector (National Emergency Management Agency) Order 2019.

2 Commencement

This order comes into force on 1 December 2019.

3 Schedule 1A of State Sector Act 1988 amended

In the State Sector Act 1988, Schedule 1A, insert in its appropriate alphabetical order:

4 Application of consequential changes to references provisions

(1)

This clause applies in respect of all civil defence emergency management functions that are transferred from the chief executive of the Department of the Prime Minister and Cabinet to the chief executive of the National Emergency Management Agency.

(2)

Sections 30H and 30I of the State Sector Act 1988 apply to enactments or other things coming into force, entered into, or created during the transitional period beginning on 1 December 2019 and ending on 30 November 2020, after the transfer of functions referred to in subclause (1).

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on 1 December 2019, inserts the National Emergency Management Agency into Schedule 1A of the State Sector Act 1988 (the Act) as a departmental agency hosted by the Department of the Prime Minister and Cabinet. That departmental agency replaces the Ministry of Civil Defence and Emergency Management (a business unit within the Department of the Prime Minister and Cabinet).

The order also applies sections 30H and 30I of the Act to the transfer of civil defence emergency management functions from the chief executive of the Department of the Prime Minister and Cabinet to the chief executive of the National Emergency Management Agency. Those sections concern consequential changes to references to departments, employees, and chief executives following re-organisations. The sections will apply to enactments or other things coming into force, entered into, or created during a transitional period beginning on 1 December 2019 and ending on 30 November 2020.
