Regulations

1 Title

These regulations are the Road User Charges (Rates) Amendment Regulations 2020.

2 Commencement

These regulations come into force on 1 July 2020.

Order: confirmed, on 12 December 2020, by section 12(a) of the Subordinate Legislation Confirmation Act 2020 (2020 No 66).

3 Principal regulations

These regulations amend the Road User Charges (Rates) Regulations 2015 (the principal regulations).

4 Regulation 3 amended (Interpretation)

(1)

In regulation 3(1), definition of additional weight, replace “section 4.5(1) of the VDAM Rule 2002” with “section 4 of the VDAM Rule 2016”.

(2)

In regulation 3(1), definitions of single large-tyred axle and twin-tyred axle, replace “VDAM Rule 2002” with “VDAM Rule 2016”.

5 Regulation 4 amended (Rates of road user charges)

(1)

In regulation 4(1), replace “a type H vehicle or an all-terrain crane” with “type H vehicles, all-terrain cranes, and overweight specialist RUC vehicles”.

The rates of road user charges for a distance licence for overweight specialist RUC vehicles are the rates specified in Schedule 5.

The rates of road user charges for each 1,000 kg of additional weight carried by a powered RUC vehicle (except an all-terrain crane) operating under an additional licence are the rates specified in Schedule 6.

(7)

The rates of road user charges for each 1,000 kg of additional weight carried by an all-terrain crane operating under an additional licence are the rates specified in Schedule 7.

The rates of road user charges for each 1,000 kg of additional weight carried by a combination vehicle (except an all-terrain crane) operating under an additional licence are the rates specified in Schedule 8.

6 Regulation 5 amended (Rates inclusive of GST)

In regulation 5, replace “Schedules 1 to 7” with “Schedules 1 to 8”.

7 Schedules 1 to 7 replaced

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 1 July 2020, amend the Road User Charges (Rates) Regulations 2015 by—

increasing the prescribed rates of road user charges payable under the Road User Charges Act 2012; and
prescribing rates for charges applicable to new RUC vehicle types: further type H vehicles and overweight specialist RUC vehicles (passenger service vehicles, concrete mixers, ground-spreader trucks, and rubbish trucks).

This order is a confirmable instrument under section 47B of the Legislation Act 2012. It is revoked at the close of 30 June 2021, unless earlier confirmed by an Act of Parliament. That stated time is the applicable deadline under section 47C(1)(a) of that Act.

Regulatory impact assessment

The Ministry of Transport produced a regulatory impact assessment on 3 March 2020 to help inform the decisions taken by the Government relating to the contents of this instrument.
