New Zealand Public Service Medal Amendment Regulations 2020

These regulations are made in accordance with the Royal Warrant (LI 2018/134) dated 19 July 2018 instituting and creating The New Zealand Public Service Medal and on the advice of the Prime Minister.

Regulations

1 Title

These regulations are the New Zealand Public Service Medal Amendment Regulations 2020.

2 Commencement

These regulations come into force on the 28th day after the date of their notification in the Gazette.

3 Principal regulations

These regulations amend the New Zealand Public Service Medal Regulations 2018 (the principal regulations).

4 Regulation 3 amended (interpretation)

(1)

In regulation 3, insert in their appropriate alphabetical order:

Crown agent means a statutory entity named in Part 1 of Schedule 1 of the Crown Entities Act 2004

department means an agency listed in Part 1 of Schedule 2 of the Public Service Act 2020

departmental agency means an agency listed in the first column of the table in Part 2 of Schedule 2 of the Public Service Act 2020

functional chief executive has the meaning given in section 5 of the Public Service Act 2020

In regulation 3, replace the definition of public service with:

public service means—

(a)

the public service agencies listed in Schedule 2 of the Public Service Act 2020; and

(b)

Crown agents

In regulation 3, replace the definition of public service employee with:

public service employee means—

(a)

a public service employee as defined in section 65 of the Public Service Act 2020; and

(b)

a chief executive of a department or departmental agency, or a functional chief executive; and

(c)

an employee of a Crown agent

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on the 28th day after the date of their notification in the Gazette, amend the New Zealand Public Service Medal Regulations 2018. The amendments will extend eligibility for the New Zealand Public Service Medal to employees of Crown agents as defined in the Crown Entities Act 2004.

The reference to chief executives in the definition of public service employee is reinstated (as it was omitted in error in changes made to the regulations by the Public Service Act 2020). Also, a reference to the role of functional chief executive (created by the Public Service Act 2020) is added to that definition.
