Lawyers and Conveyancers Act (Lawyers) Amendments to Constitution 2020

Pursuant to section 70 of the Lawyers and Conveyancers Act 2006, the Schedule sets out amendments—

(a)

to the Constitution of the New Zealand Law Society (as made by the Society on 18 July 2008); and

(b)

adopted by the Society on 15 October 2020 or consequential to those amendments.

1 Title

This legislative instrument is the Lawyers and Conveyancers Act (Lawyers) Amendments to Constitution 2020.

2 Commencement

This legislative instrument comes into force on the day after the date of its notification in the Gazette.

3 Amendments to Constitution of New Zealand Law Society

(1)

Part 1 of the Schedule sets out amendments—

(a)

to the Constitution of the New Zealand Law Society (the Constitution) as made by the Society on 18 July 2008; and

(b)

adopted by the Society on 15 October 2020.

(2)

Part 2 of the Schedule sets out amendments to the Constitution that are consequential to the amendments made by the Society on 15 October 2020.

Part B, rule 4.1

In rule 4.1(g), replace “.” with “:”.

After rule 4.1(g), insert:

(h)

a representative of Te Hunga Rōia Māori o Aotearoa (the Māori Law Society):

(i)

a representative of the Pacific Lawyers Association.

Part 2Consequential amendments

Part B, rule 1.1

In rule 1.1, definition of constituent, replace “rule 4.1(f) and (g)” with “rule 4.1(f) to (i)”.

Part B, rule 4.4

In rule 4.4, replace “or (g)” with “(g), (h), or (i)”.

Part B, rule 7.8

In rule 7.8(b), replace “or (g)” with “(g), (h), or (i)”.

Explanatory note

This legislative instrument, which amends the Constitution of the New Zealand Law Society (the Constitution) comes into force on the day after the date of its notification in the Gazette.

Part 1 of the Schedule sets out amendments to Part B of the Constitution to reflect a resolution of the Council of the Law Society made on 15 October 2020 to include representatives of Te Hunga Rōia Māori o Aotearoa (the Māori Law Society) and the Pacific Lawyers Association as members of the Council.

Part 2 of the Schedule consequentially amends Part B of the Constitution to ensure that representatives of Te Hunga Rōia Māori o Aotearoa and the Pacific Lawyers Association are in the same position as the other constituent members of the Council.
