These regulations are made under section 92 of the New Zealand Public Health and Disability Act 2000 and section 437 of the Social Security Act 2018 on the advice and with the consent of the Executive Council.

Regulations

1 Title

These regulations are the Health Entitlement Cards Amendment Regulations 2021.

2 Commencement

These regulations come into force on 1 April 2021.

3 Principal regulations

These regulations amend the Health Entitlement Cards Regulations 1993 (the principal regulations).

4 Regulation 8 amended (Eligibility for community services cards)

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 1 April 2021, amend regulation 8 of the Health Entitlement Cards Regulations 1993 to increase the income entitlement thresholds that are used to determine a person’s eligibility for a community services card.

The new entitlement thresholds reflect an increase of 1.15% in the New Zealand Consumers Price Index (CPI) from the December 2019 quarter to the December 2020 quarter (calculated for all quarters using the New Zealand Consumers Price Index (All Groups), excluding cigarettes and other tobacco products).

Regulation 8(5A)(a), (b), and (c) is amended to reflect the value of the 66% wage floor adjustment to the respective New Zealand Superannuation rates, where this gives a larger amended rate than CPI alone.
