This order is made under section 358 of the Sale and Supply of Alcohol Act 2012

(a)

on the advice and with the consent of the Executive Council; and

(b)

on the advice of the Minister of Justice given at the request of the Ashburton Licensing Trust.

1 Title

This order is the Sale and Supply of Alcohol (Vesting of Undertaking of Ashburton Licensing Trust in Braided Rivers Community Trust) Order 2021.

2 Commencement

This order comes into force on 8 July 2021.

3 Ashburton Licensing Trust’s undertaking to vest in Braided Rivers Community Trust on 12 July 2021

The Ashburton Licensing Trust’s undertaking is vested in the Braided Rivers Community Trust on 12 July 2021.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on 8 July 2021, specifies 12 July 2021 as the date on which the Ashburton Licensing Trust’s undertaking is vested in the Braided Rivers Community Trust. The effect is that, on that date,—

  • the Ashburton Licensing Trust is dissolved; and

  • all real and personal property of the Ashburton Licensing Trust, including all licences under the Sale and Supply of Alcohol Act 2012 (the Act), vests in the Braided Rivers Community Trust; and

  • all money payable to or by the Ashburton Licensing Trust is payable to or by the Braided Rivers Community Trust; and

  • all liabilities, contracts (including employment contracts), and engagements, and all rights and authorities (except for the exclusive right referred to in section 349(2) of the Act), of the Ashburton Licensing Trust are the liabilities, contracts, engagements, rights, and authorities of the Braided Rivers Community Trust; and

  • all proceedings by or against the Ashburton Licensing Trust may be carried on or prosecuted by or against the Braided Rivers Community Trust.
