This order is made under section 337(1)(a), (b), and (h) of the Sale and Supply of Alcohol Act 2012

(a)

on the advice and with the consent of the Executive Council; and

(b)

on the recommendation of the Minister of Justice.

Order

1 Title

This order is the Sale and Supply of Alcohol (Clutha Licensing Trust—Variation in Number of Members and Abolition of Wards) Order 2021.

2 Commencement

This order comes into force on 8 July 2021.

3 Application

(1)

Clause 4 takes effect, under section 338 of the Sale and Supply of Alcohol Act 2012, only at the next triennial general election of members, except to the extent that is necessary for holding that election.

(2)

Clauses 5 and 6 take effect only at the next triennial general election of members, except to the extent that is necessary for holding that election.

4 Abolition of Clutha Licensing Trust district wards

The wards of the Clutha Licensing Trust are abolished.

5 Number of Clutha Licensing Trust members varied

The Clutha Licensing Trust consists of 5 members.

6 Number of members required for quorum varied

At any meeting of the Clutha Licensing Trust, 3 members is a quorum.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on 8 July 2021, abolishes the wards of the Clutha Licensing Trust (the Trust) and reduces the number of elected members of the Trust from 9 to 5. The order also varies the number of members required for a quorum from 4 to 3 as a consequence of the reduced number of members. The changes take effect only at the next triennial general election of members, except to the extent that is necessary for holding that election. This order is to be read alongside the Clutha Licensing Trust Order 1955.
