The Remuneration Authority makes this determination (including the appended explanatory memorandum) under the Remuneration Authority Act 1977 and clauses 6 and 7A of Schedule 7 of the Local Government Act 2002, after having regard to the matters specified in clause 7 of that schedule.

Determination

1 Title

This determination is the Local Government Members (2021/22) Amendment Determination 2021.

2 Commencement

This determination is deemed to have come into force on 1 July 2021.

3 Principal determination
4 Clause 9 amended (Motor vehicles for mayors and regional council chairpersons)

(1)

In clause 9(2)(a) and (b), delete “(including goods and services tax and any on-road costs)”.

(2)

In clause 9(5) and (6), formula, replace “actual purchase price of the vehicle, including goods and services tax and any on-road costs” with “purchase price of the vehicle”.

(3)

In clause 9(7), insert in its appropriate alphabetical order:

purchase price means the amount paid for the vehicle,—

(a)

including goods and services tax and any on-road costs; and

(b)

after deducting the amount of any rebate that applies under the clean vehicle discount scheme in respect of the purchase of the vehicle

5 Schedule amended

(1)

In the Schedule, Part 2, item relating to Auckland Council, replace the heading Great Barrier Local Board with Aotea/Great Barrier Local Board.

(2)

In the Schedule, Part 2, replace the item relating to Manawatu District Council with:

Explanatory memorandum

This memorandum is not part of the determination, but is intended to indicate its general effect.

This determination amends the Local Government Members (2021/22) Determination 2021 (the principal determination).

Clause 4 amends clause 9 of the principal determination, which sets out the motor vehicle entitlements for mayors and regional council chairpersons. The amendment applies the recently introduced Government Clean Car Discount (the rebate) that local authorities may receive for eligible vehicles they provide to their mayors and chairpersons. The amendment enables the rebate that a local authority has received to be deducted from the purchase price of the eligible motor vehicle before calculating the deduction from the remuneration of the local authority’s mayor or chairperson for the full or partial private use of the eligible vehicle.

All amendments to Part 2 of the Schedule of the principal determination are made at the request of the councils concerned. This determination is deemed to have come into effect on 1 July 2021.

1 General
