Building (Product Certification) Amendment Regulations 2021

These regulations are made under section 402(1) of the Building Act 2004

(a)

on the advice and with the consent of the Executive Council; and

(b)

on the recommendation of the Minister for Building and Construction.

Regulations

1 Title

These regulations are the Building (Product Certification) Amendment Regulations 2021.

2 Commencement

These regulations come into force on 14 October 2021.

In regulation 2(2), replace “2021” with “2022”.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

Together with the Building Act 2004, the Building (Product Certification) Regulations 2008 (the principal regulations) provide the legislative basis for the CodeMark scheme in New Zealand, which is a building product certification scheme administered by the Ministry of Business, Innovation, and Employment. In 2019, the Building (Product Certification) Amendment Regulations 2019 (the 2019 amendment regulations) were made to amend the principal regulations.

Regulations 9 and 10(3) of the 2019 amendment regulations relate to conditions that must be met in order for product certification bodies to accept test reports from a testing laboratory in respect of a building method or product, or to test building methods or products at a testing laboratory. Currently, they come into force on 1 November 2021. These regulations extend that date to 1 November 2022.

These regulations come into force on 14 October 2021.
