These regulations are made under section 402(1) of the Building Act 2004

(a)

on the advice and with the consent of the Executive Council; and

(b)

on the recommendation of the Minister for Building and Construction.

Regulations

1 Title

These regulations are the Building (Infringement Offences, Fees, and Forms) Amendment Regulations 2021.

2 Commencement

These regulations come into force on 14 October 2021.

In Schedule 2, form, delete Method for payment of infringement fee(s) and revoke the paragraph below that heading.

5 Schedule 3 amended

In Schedule 3, form, delete Method for payment of infringement fee(s) and revoke the paragraph below that heading.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 14 October 2021, amend Schedules 2 and 3 of the Building (Infringement Offences, Fees, and Forms) Regulations 2007. The effect of the amendments is to remove from the forms relating to infringement notices the references to outdated methods of payment (such as payment by cheque). It will now be for the relevant enforcement authorities to decide on the appropriate methods of payment of infringement notices.
