This order is made under section 60 of the Climate Change Response Act 2002—
on the advice and with the consent of the Executive Council; and
on the recommendation of the Minister of Climate Change made after complying with that section and sections 3A and 3B of that Act.
This order is the Climate Change (General Exemptions) Amendment Order 2021.
This order comes into force on 1 January 2022.
This order amends the Climate Change (General Exemptions) Order 2009.
After clause 13A, insert:

A person who carries out the activity of operating a disposal facility is exempt as a participant in respect of the part of the activity involving the disposal of waste that—
had previously been disposed of at a landfill that is now a closed landfill; and
is disposed of by the disposal facility on or after 1 January 2022.

In this section, closed landfill means a landfill that is no longer accepting waste for disposal.

This order, which comes into force on 1 January 2022, amends the Climate Change (General Exemptions) Order 2009 (the principal order).
This order amends the principal order to partly exempt persons who operate disposal facilities from being participants under the Climate Change Response Act 2002. A person who operates a disposal facility is exempt in relation to waste disposed of by the facility from 1 January 2022 that was previously disposed of at a landfill that is now a closed landfill.
