Russia Sanctions Amendment Regulations 2022

These regulations are made under section 9 of the Russia Sanctions Act 2022

(a)

on the advice and with the consent of the Executive Council; and

(b)

on the recommendation of the Minister of Foreign Affairs made in accordance with section 8 of that Act.

Regulations

1 Title

These regulations are the Russia Sanctions Amendment Regulations 2022.

2 Commencement

These regulations come into force on 5 April 2022.

3 Principal regulations

These regulations amend the Russia Sanctions Regulations 2022.

4 Regulation 12 amended (Sanctions on assets and services do not apply in certain circumstances)

After regulation 12(7)(d), insert:

(e)

for the purpose of facilitating the normal performance of the functions of—

(i)

a diplomatic mission (within the meaning of the Vienna Convention on Diplomatic Relations signed in 1961); or

(ii)

a consular post (within the meaning of the Vienna Convention on Consular Relations signed in 1963).

5 Schedule amended

(1)

In the Schedule, table, Part 2, insert in their appropriate alphabetical order the items set out in Part 1 of the Schedule of these regulations.

(2)

In the Schedule, table, Part 2, second column, opposite each of the names specified in the first column of the table set out in Part 2 of the Schedule of these regulations, insert the item set out opposite each of those names in the second column of that table.

(3)

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 5 April 2022, amend the Russia Sanctions Regulations 2022 (the principal regulations).

Regulation 4 ensures that the normal diplomatic functions of an embassy or consular post (whether in New Zealand or in another country) are able to continue in accordance with the Vienna Conventions despite the sanctions in the principal regulations.

Regulation 5 adds the following additional sanctions to the principal regulations:

  • new names are added, so that the principal regulations apply to more people (regulation 5(1)):

  • some persons and classes of persons who are already sanctioned by the principal regulations will be subject to further sanctions (regulation 5(2)).

Middle names are recorded for 5 people already named in the regulations, who will now be subject to further sanctions (regulation 5(3) to (7)).

All the additional sanctions fulfil the purpose of the regulations, which is to give effect to the Russia Sanctions Act 2022 by imposing sanctions in response to Russia’s military actions in relation to Ukraine (and in response to any assistance from any other country or person).
