Regulations

1 Title

These regulations are the Fisheries (Amateur Fishing) Amendment Regulations (No 2) 2022.

2 Commencement

These regulations come into force on 5 May 2022.

3 Principal regulations

Amendment to preliminary provisions

4 Regulation 8 amended (Interpretation: fish species)

In regulation 8, insert in their appropriate alphabetical order:

baitfish means a fish of any of the following species:

(a)

Decapterus koheru (known as koheru) or Decapterus muroadsi (known as scad):

(b)

Engraulis australis (known as kokowhaawhaa/anchovy):

(c)

garfish (including fish of the species Euleptorhamphus viridis):

(d)

mackerel (other than fish of the species Scomber australasicus):

(e)

pilchard (other than fish of the genus Sprattus):

(f)

Sprattus antipodum (known as kupae/slender sprat) or Sprattus muelleri (known as stout sprat):

(g)

yellow-eyed mullet

southern bluefin tuna means a fish of the species Thunnus maccoyii

Amendments to general provisions

5 New regulations 11A and 11B inserted

After regulation 11, insert:

11A Daily limit for baitfish

(1)

A person must not, on any day, take or possess more than 50 baitfish (the daily limit for baitfish).

(2)

A person contravenes this subclause if the person, on any day, takes or possesses more than the daily limit for baitfish, but not more than 3 times that daily limit.

(3)

A person contravenes this subclause if the person, on any day, takes or possesses more than 3 times the daily limit for baitfish.

(4)

A person who contravenes—

(a)

subclause (2) commits an offence and is liable on conviction to a fine not exceeding $10,000:

(b)

subclause (3) commits a serious non-commercial offence and is liable on conviction to a fine not exceeding $20,000.

11B Daily limit for southern bluefin tuna

(1)

A person must not, on any day, take or possess more than 1 southern bluefin tuna (the daily limit for southern bluefin tuna).

(2)

A person contravenes this subclause if the person, on any day, takes or possesses more than the daily limit for southern bluefin tuna, but not more than 3 times that daily limit.

(3)

A person contravenes this subclause if the person, on any day, takes or possesses more than 3 times the daily limit for southern bluefin tuna.

(4)

A person who contravenes—

(a)

subclause (2) commits an offence and is liable on conviction to a fine not exceeding $10,000:

(b)

subclause (3) commits a serious non-commercial offence and is liable on conviction to a fine not exceeding $20,000.

6 New regulation 17B inserted (Combined daily limits for finfish do not apply to eels or baitfish)

After regulation 17A, insert:

17B Combined daily limits for finfish do not apply to eels or baitfish

The combined daily limits for finfish that are set by these regulations do not apply to eels or baitfish.

Amendments relating to Auckland and Kermadec FMA

7 Regulation 55 replaced (Combined daily limit for fish (including individual species limits) in Auckland and Kermadec FMA)

Replace regulation 55 with:

55 Daily limits for finfish in Auckland and Kermadec FMA

(1)

A person must not, on any day,—

(a)

take more than the total quantity of finfish specified in Part 1 of Schedule 6 (the combined daily limit for finfish) from the Auckland and Kermadec FMA; or

(b)

possess more than the combined daily limit for finfish in the Auckland and Kermadec FMA; or

(c)

possess more than the combined daily limit for finfish taken from within the Auckland and Kermadec FMA.

(2)

A person must not, on any day,—

(a)

take more than the total quantity of hapuku/bass and kingfish specified in Part 2 of Schedule 6 (the combined daily limit for hapuku/bass and kingfish) from the Auckland and Kermadec FMA; or

(b)

possess more than the combined daily limit for hapuku/bass and kingfish in the Auckland and Kermadec FMA; or

(c)

possess more than the combined daily limit for hapuku/bass and kingfish taken from within the Auckland and Kermadec FMA.

(3)

A person must not, on any day,—

(a)

take more than the individual limit for a species of finfish specified in Part 3 of Schedule 6 (the daily limit for a species of finfish) from the Auckland and Kermadec FMA; or

(b)

possess more than the daily limit for a species of finfish in the Auckland and Kermadec FMA; or

(c)

possess more than the daily limit for a species of finfish taken from within the Auckland and Kermadec FMA.

(4)

A person contravenes this subclause if the person, on any day, takes or possesses more than the combined daily limit for finfish, the combined daily limit for hapuku/bass and kingfish, or the daily limit for a species of finfish, but not more than 3 times that daily limit.

(5)

A person contravenes this subclause if the person, on any day, takes or possesses more than 3 times—

(a)

the combined daily limit for finfish; or

(b)

the combined daily limit for hapuku/bass and kingfish; or

(c)

the daily limit for a species of finfish.

(6)

A person who contravenes—

(a)

subclause (4) commits an offence and is liable on conviction to a fine not exceeding $10,000:

(b)

subclause (5) commits a serious non-commercial offence and is liable on conviction to a fine not exceeding $20,000.

8 Regulations 56 to 58 revoked

Replace regulation 59 with:

59 Daily limit for snapper in Auckland (East) FMA and Auckland (West) FMA

(1)

The daily limits for snapper that are set by this regulation apply in the Auckland (East) FMA and the Auckland (West) FMA instead of the daily limit for snapper that is set by regulation 55.

(2)

A person must not, on any day,—

(a)

take more than 10 snapper (the daily limit for snapper for the Auckland (West) FMA) from the Auckland (West) FMA; or

(b)

possess more than the daily limit for snapper for the Auckland (West) FMA in that area; or

(c)

possess more than the daily limit for snapper for the Auckland (West) FMA taken from within that area.

(3)

A person must not, on any day,—

(a)

take more than 7 snapper (the daily limit for snapper for the Auckland (East) FMA) from the Auckland (East) FMA; or

(b)

possess more than the daily limit for snapper for the Auckland (East) FMA in that area; or

(c)

possess more than the daily limit for snapper for the Auckland (East) FMA taken from within that area.

(4)

A person contravenes this subclause if the person, on any day, takes or possesses more than the daily limit for snapper for the Auckland (West) FMA or the daily limit for snapper for the Auckland (East) FMA, but not more than 3 times that daily limit.

(5)

A person contravenes this subclause if the person, on any day, takes or possesses more than 3 times—

(a)

the daily limit for snapper for the Auckland (West) FMA; or

(b)

the daily limit for snapper for the Auckland (East) FMA.

(6)

A person who contravenes—

(a)

subclause (4) commits an offence and is liable on conviction to a fine not exceeding $10,000:

(b)

subclause (5) commits a serious non-commercial offence and is liable on conviction to a fine not exceeding $20,000.

possess more than the daily limit for a species of finfish taken from within the Central FMA.

(4)

A person contravenes this subclause if the person, on any day, takes or possesses more than the combined daily limit for finfish, the combined daily limit for hapuku/bass and kingfish, or the daily limit for a species of finfish, but not more than 3 times that daily limit.

(5)

A person contravenes this subclause if the person, on any day, takes or possesses more than 3 times—

(a)

the combined daily limit for finfish; or

(b)

the combined daily limit for hapuku/bass and kingfish; or

(c)

the daily limit for a species of finfish.

(6)

A person who contravenes—

(a)

subclause (4) commits an offence and is liable on conviction to a fine not exceeding $10,000:

(b)

subclause (5) commits a serious non-commercial offence and is liable on conviction to a fine not exceeding $20,000.

(b)

the blue cod were not taken in breach of the regulations.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 5 May 2022, amend the Fisheries (Amateur Fishing) Regulations 2013 (the principal regulations). The amendments relate to daily limits that are set by the principal regulations for the number of finfish (or particular species of finfish) that a person may take or possess on any single day. Mainly, the amendments—

  • set a daily limit of 50 for baitfish (see new regulation 11A):

  • set a daily limit of 1 for southern bluefin tuna (see new regulation 11B):

  • set a combined daily limit for all finfish (other than eels or baitfish) taken from, or possessed in, each fisheries management area (FMA), as follows:

    • a total quantity of 20 finfish for each of the Auckland and Kermadec FMA, the Central FMA, and the Challenger FMA (see new regulations 55(1), 78(1), and 92(1)):

    • a total quantity of 30 finfish for each of the South-East FMA and the Southland and Sub-Antarctic FMA (see new regulations 117(1) and 141(1)):

  • reduce the daily limit for grey mullet taken from, or possessed in, the Auckland and Kermadec FMA from 30 to 20 (see new regulation 55(3)).

Within the combined daily limits for all finfish that are set for each FMA, daily limits apply to particular species of finfish. These regulations relocate where some of those limits are specified within the principal regulations so that—

  • the daily limits for finfish (or particular species of finfish) that apply to an entire FMA are specified in new Schedules 6 to 9 and 11 of the principal regulations; and

  • the daily limits for finfish (or particular species of finfish) that apply only to a part of an FMA are specified in the body of the principal regulations.

These regulations also make consequential amendments to the infringement offences and fees set out in Schedule 19 of the principal regulations.
