These regulations are made under section 29(1) of the New Zealand Business Number Act 2016

(a)

on the advice and with the consent of the Executive Council; and

(b)

on the recommendation of the Minister for Small Business made in accordance with section 29(2) of that Act.

Regulations

1 Title

These regulations are the New Zealand Business Number (Authority to Require NZBN) Amendment Regulations 2022.

2 Commencement

These regulations come into force on 23 May 2022.

3 Principal regulations
4 New regulation 7 inserted (MBIE may require NZBN for accreditation of employers to support work visa applications)

After regulation 6, insert:

7 MBIE may require NZBN for accreditation of employers to support work visa applications

(1)

MBIE is authorised to require an employer accreditation applicant to register for an NZBN and to provide the NZBN to MBIE.

(2)

In this regulation, employer accreditation applicant means an eligible entity that makes an application described in regulation 26AA(n) of the Immigration (Visa, Entry Permission, and Related Matters) Regulations 2010.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations are made under section 29 of the New Zealand Business Number Act 2016. Section 29 provides for a government agency to be authorised to require an entity that is eligible for an NZBN (an eligible entity), and to which the agency provides services, to register for an NZBN (if it does not already have one) and to provide the NZBN to the agency.

The New Zealand Business Number (Authority to Require NZBN) Regulations 2020 (the principal regulations) set out when agencies may require an eligible entity to obtain and provide an NZBN.

These regulations, which come into force on 23 May 2022, amend the principal regulations to authorise the Ministry of Business, Innovation, and Employment to require an NZBN from eligible entities applying for employer accreditation to support work visa applications made by their employees or prospective employees.
