This determination (to which is appended an explanatory memorandum) is made by the Remuneration Authority under section 17 of the Members of Parliament (Remuneration and Services) Act 2013 and under the Remuneration Authority Act 1977 after complying with section 18 of the Members of Parliament (Remuneration and Services) Act 2013.
This determination is the Members of Parliament (Accommodation Services for Members and Travel Services for Family Members) Amendment Determination 2022.
This determination is deemed to have come into force on 1 February 2022.
This determination amends the Members of Parliament (Accommodation Services for Members and Travel Services for Family Members) Determination 2020.
After clause 40, insert:
(1)
This clause applies if—
a member of Parliament (including the Prime Minister, the Speaker, the Deputy Speaker, or a Minister) receives a continuous accommodation payment in respect of Wellington accommodation; and
the member is temporarily unable to use their continuous Wellington accommodation and must use alternative Wellington accommodation because of a circumstance that is unavoidable and beyond the member’s control.
(2)
If this clause applies, a non-continuous accommodation payment in respect of the alternative Wellington accommodation for the period that the member is unable to use their continuous Wellington accommodation may be authorised.
(3)
The maximum non-continuous accommodation payment that may be authorised under this clause is the same as the maximum amount specified in clause 18(3)(a), 22(2)(a), 28(2)(a), or 34(1) (whichever applies to the member).
(4)
The responsibility for granting an authorisation under this clause is to be determined in accordance with section 7 of the Parliamentary Service Act 2000.

This determination, which is deemed to come into force on 1 February 2022, makes a change to the Members of Parliament (Accommodation Services for Members and Travel Services for Family Members) Determination 2020 to enable additional accommodation support to be paid to a member of Parliament who, because of a circumstance that is unavoidable and beyond the member’s control, is temporarily unable to use their usual Wellington accommodation (for which they receive a continuous payment) and must pay for alternative accommodation. An example of a circumstance in which additional support may be payable under this provision would be where security risks had temporarily prevented a member from accessing their usual Wellington accommodation.
