Russia Sanctions Amendment Regulations (No 3) 2022

These regulations are made under sections 9 and 32 of the Russia Sanctions Act 2022

(a)

on the advice and with the consent of the Executive Council; and

(b)

on the recommendation of the Minister of Foreign Affairs made in accordance with sections 8 and 32(1)(c) of that Act.

Regulations

1 Title

These regulations are the Russia Sanctions Amendment Regulations (No 3) 2022.

2 Commencement

These regulations come into force on 3 May 2022.

3 Principal regulations

These regulations amend the Russia Sanctions Regulations 2022.

4 Part 1 of Schedule 2 amended

(1)

In Schedule 2, table, Part 1, second column, delete “, 12” in each place.

(2)

In Schedule 2, table, Part 1, second column, replace “r 11” with “rr 8, 9, 10, 10A, 11” in each place.

(3)

In Schedule 2, table, Part 1, item relating to Promsvyazbank (PSB), second column, before “10,”, insert “8, 9,”.

(4)

In Schedule 2, table, Part 1, insert in their appropriate alphabetical order the items set out in Part 1 of the Schedule of these regulations.

5 Part 2 of Schedule 2 amended

(1)

In Schedule 2, table, Part 2, delete the items relating to Konstantin Fyodorovich Zatulin, Pyotr Olegovich Tolstoy and Vladimir Antyufeyev.

In Schedule 2, table, Part 2, insert in its appropriate alphabetical order:

6 Part 3 of Schedule 2 amended

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 3 May 2022, amend the Russia Sanctions Regulations 2022 (the principal regulations).

All the amendments fulfil the purpose of the regulations, which is to give effect to the Russia Sanctions Act 2022 by imposing sanctions in response to Russia’s military actions in relation to Ukraine (and in response to any assistance from any other country or person).

Additional sanctions are added to the sanctions regime as follows:

  • new names are added, so that the principal regulations apply to more entities (regulation 4(4)) and more individuals (regulation 5(3)):

  • some persons and classes of persons who are already sanctioned by the principal regulations will be subject to further sanctions (regulations 4(2), 4(3), 5(4), and 6(2)):

  • a middle name is recorded for an individual already named in the regulations, who will now be subject to further sanctions (regulation 5(1) and (2)):

  • a new class of persons is added, namely certain members of the Federation Council of the Federal Assembly (regulation 6(1)).

The names of 2 individuals are removed from the principal regulations (regulation 5(1)).

An erroneous reference to regulation 12 is deleted from Part 1 of Schedule 2 (regulation 4(1)).
