2 Commencement

This order comes into force on 12 May 2022.

4 Revocation of this order

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order revokes the COVID-19 Public Health Response (Vaccination Assessment Tool) Regulations 2021 (the regulations). This order comes into force on 12 May 2022 and is revoked on 12 June 2022.

The regulations prescribe an assessment tool for the purposes of section 33AB of the COVID-19 Public Health Response Act 2020 (the Act). That section gives a person conducting a business or undertaking (a PCBU) an absolute discretion to decide whether to use the prescribed assessment tool to ascertain whether it is reasonable to require workers of the PCBU not to carry out work for the PCBU unless the workers are vaccinated. The revocation of the regulations means that there will be no assessment tool prescribed for the purposes of section 33AB of the Act.

Issued under the authority of the Legislation Act 2019.

Date of notification in Gazette: 10 May 2022.
