Wine Amendment Regulations 2022

These regulations are made under section 89 of the Wine Act 2003

(a)

on the advice and with the consent of the Executive Council; and

(b)

on the recommendation of the Minister for Food Safety made after complying with section 89(4) of that Act.

Regulations

1 Title

These regulations are the Wine Amendment Regulations 2022.

2 Commencement

These regulations come into force on 1 July 2022.

3 Principal regulations

These regulations amend the Wine Regulations 2021.

4 Regulation 126 amended (Levies)

In regulation 126(8), replace “Part 2” with “clause 5”.

5 Schedule 1 amended

In Schedule 1, revoke the Part 2 heading.

In Schedule 1, clause 5(1)(a), replace “$0.01” with “$0.005”.

In Schedule 1, replace clause 5(2) with:

The rate of the levy prescribed under subclause (1)(a) applies to the 2022 financial year and all subsequent years until a new rate is notified under regulation 126(3).

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations amend the Wine Regulations 2021 (the principal regulations) so that, until a new levy rate is notified under regulation 126 of the principal regulations, the levy rate for the purposes of that regulation is $0.005 per litre of wine exported. These regulations come into force on 1 July 2022. Before then, the levy rate is $0.01 per litre of wine exported.

These regulations must be confirmed by an Act before the close of 30 June 2023. If they are not confirmed, they will be revoked on the close of that date. See subpart 3 of Part 5 of the Legislation Act 2019.
