Building (Forms) Amendment Regulations 2022

These regulations are made under section 402(1) of the Building Act 2004 on the advice and with the consent of the Executive Council and on the recommendation of the Minister for Building and Construction.

Regulations

1 Title

These regulations are the Building (Forms) Amendment Regulations 2022.

2 Commencement

These regulations come into force on 7 September 2022.

3 Principal regulations

These regulations amend the Building (Forms) Regulations 2004.

4 New regulation 3A inserted (Transitional, savings, and related provisions)

After regulation 3, insert:

3A Transitional, savings, and related provisions

The transitional, savings, and related provisions set out in Schedule 1 have effect according to their terms.

5 New Schedule 1 inserted

Insert the Schedule 1 set out in the Schedule of these regulations as the first schedule to appear after the last regulation of the principal regulations.

6 Schedule amended

(1)

In the Schedule heading, replace “Schedule” with “Schedule 2”.

(2)

In the Schedule, form 2, under the heading “†Attachments”, after “†Plans and specifications [list]”, insert:

†Current product certificate(s)

†Current manufacturer’s certificate(s) referred to in section 45(1)(bb) of the Act

†Current manufacturer’s certificate(s) referred to in section 45(1)(bc) of the Act

In the Schedule, form 6, under the heading “Attachments”, after “¶Evidence that specified systems are capable of performing to the performance standards set out in the building consent”, insert:

Part 1 Provision relating to Building (Forms) Amendment Regulations 2022

1 Amendments to forms do not apply to applications for building consent made before 7 September 2022

(1)

An application for a building consent made before 7 September 2022 must be dealt with as if the Building (Forms) Amendment Regulations 2022 had not been made.

(2)

An application for a code compliance certificate made before 7 September 2022 must be dealt with as if the Building (Forms) Amendment Regulations 2022 had not been made.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 7 September 2022, amend forms 2 and 6 of the Building (Forms) Regulations 2004. The minor amendments made by these regulations are required to give effect to certain changes made by the Building (Building Products and Methods, Modular Components, and Other Matters) Amendment Act 2021.

The amendments to forms 2 and 6 do not apply to—

  • an application for a building consent made before 7 September 2022:

  • an application for a code compliance certificate made before 7 September 2022.
