Student Allowances (Income Exemptions—Cost of Living Payment) Amendment Regulations 2022

These regulations are made under section 645 of the Education and Training Act 2020 on the advice and with the consent of the Executive Council.

Regulations

1 Title

These regulations are the Student Allowances (Income Exemptions—Cost of Living Payment) Amendment Regulations 2022.

2 Commencement

These regulations come into force on 1 August 2022.

3 Principal regulations

These regulations amend the Student Allowances Regulations 1998.

4 Regulation 2 amended (Interpretation)

(1)

In regulation 2(1), insert in its appropriate alphabetical order:

cost of living payment means a payment under the cost of living payments scheme (as defined in section 3(1) of the Tax Administration Act 1994)

In regulation 2(1), definition of personal income, after paragraph (g), insert:

(h)

does not include any cost of living payment received by the student

(3)

In regulation 2(1), definition of spousal or partner’s income, after paragraph (g), insert:

(h)

does not include any cost of living payment received by the spouse or partner

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 1 August 2022, amend the Student Allowances Regulations 1998. The amendments exclude from personal income, and from spousal or partner’s income, in relation to a student, any cost of living payment—

  • under the cost of living payments scheme introduced as part of Budget 2022; and

  • made to certain people by the Inland Revenue Department.
