Electricity (Exemptions from Registration) Regulations 2022

These regulations are made under section 110 of the Electricity Industry Act 2010

(a)

on the advice and with the consent of the Executive Council; and

(b)

on the recommendation of the Minister responsible for Part 2 of that Act given after receiving a recommendation from the Electricity Authority.

Regulations

1 Title

These regulations are the Electricity (Exemptions from Registration) Regulations 2022.

2 Commencement

These regulations come into force on the 28th day after the date on which they are made.

3 Interpretation

In these regulations, unless the context otherwise requires,—

Code means the Electricity Industry Participation Code 2010

distributed generation has the same meaning as in clause 1.1(1) of the Code

ICP or installation control point has the same meaning as in clause 1.1(1) of the Code

metering equipment owner has the same meaning as in clause 1.1(1) of the Code.

4 Exemption

(1)

The following classes of persons are exempt from the requirement under section 9(1)(a) of the Act to register as an industry participant:

(a)

owners of distributed generation with less than 100 kW of nameplate capacity connected to a distribution network:

(b)

metering equipment owners who are consumers of electricity at the ICP and who own metering equipment only for the purpose of measuring electricity at the ICP.

(2)

However, the exemption in subclause (1)(a) does not apply to metering equipment owners or owners of distributed generation who would otherwise be required to register as an industry participant under section 9(1)(a) of the Act because they are included in another class of participant that is required to register.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations come into force on the 28th day after the date on which they are made. The regulations exempt, with certain exceptions, the following classes of people from the requirement under section 9(1)(a) of the Act to register as an industry participant:

  • owners of distributed generation with less than 100 kW of nameplate capacity connected to a distribution network:

  • metering equipment owners who are consumers of electricity at the ICP and who own metering equipment only for the purpose of measuring electricity at the ICP.
