This order is made under section 32(1)(a) and (b) of the Ombudsmen Act 1975 on the advice and with the consent of the Executive Council.

Order

1 Title

This order is the Ombudsmen (Aroturuki Tamariki—Independent Children’s Monitor) Order 2023.

2 Commencement

This order comes into force on 1 May 2023.

3 Principal Act

This order amends the Ombudsmen Act 1975.

4 Schedule 1 amended

In Schedule 1, Part 1A, insert in its appropriate alphabetical order:

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on 1 May 2023, inserts the name Aroturuki Tamariki—Independent Children’s Monitor into Part 1A of Schedule 1 of the Ombudsmen Act 1975 (the principal Act) as a departmental agency hosted by the Education Review Office and, accordingly, as a public service agency to which the principal Act applies.

Aroturuki Tamariki—Independent Children’s Monitor is the name of the Independent Monitoring Agency of the Oranga Tamariki System for the purposes of the Oversight of Oranga Tamariki System Act 2022 (see the Public Service (Aroturuki Tamariki—Independent Children’s Monitor) Order 2023).

A further effect of this order is that the Official Information Act 1982 also applies to Aroturuki Tamariki—Independent Children’s Monitor as a public service agency (see the definition of public service agency in section 2(1) of the Official Information Act 1982 and section 2(1) of the principal Act).
