These regulations are made under section 74 of the Residential Care and Disability Support Services Act 2018 on the advice and with the consent of the Executive Council.

Regulations

1 Title

These regulations are the Residential Care and Disability Support Services Amendment Regulations 2023.

2 Commencement

These regulations come into force on 1 April 2023.

3 Principal regulations
4 Regulation 8 amended (Clothing allowance)

In regulation 8(2), replace “$309.39” with “$331.73”.

5 Regulation 19 amended (Personal allowance)

In regulation 19, replace “$49.33” with “$52.89”.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 1 April 2023, are made under the Residential Care and Disability Support Services Act 2018 and amend the Residential Care and Disability Support Services Regulations 2018 (the principal regulations).

Regulations 4 and 5 amend the principal regulations to increase—

  • the annual clothing allowance payable under regulation 8 of the principal regulations to $331.73; and

  • the personal allowance specified in regulation 19 of the principal regulations to $52.89 per week.

The new amounts reflect a 7.22% increase in the New Zealand Consumers Price Index from the December 2021 quarter to the December 2022 quarter (calculated for all quarters using the New Zealand Consumers Price Index (All Groups)).
