This order is administered by the Ministry of Health.

This order is made by the Minister of Health under sections 11 and 15(1) of the COVID-19 Public Health Response Act 2020 in accordance with section 9 of that Act.

Order

1 Title

This order is the COVID-19 Public Health Response (Point-of-care Tests) Order Revocation Order 2023.

2 Commencement

This order comes into force on 28 April 2023.

3 Revocation

Consequential amendments to COVID-19 Public Health Response (Self-isolation Requirements) Order 2022

5 Clause 5 amended (Interpretation)

(1)

In clause 5(1), revoke the definition of authorised rapid antigen test.

(2)

In clause 5(1), definition of positive COVID-19 result, paragraph (b), replace “an authorised” with “a”.

This order is revoked on 28 May 2023.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order revokes the COVID-19 Public Health Response (Point-of-care Tests) Order 2021 (the principal order), which places restrictions on importing, manufacturing, supplying, selling, packing, or using a point-of-care test for SARS-CoV-2 or COVID-19.

This order also makes consequential amendments to the COVID-19 Public Health Response (Self-isolation Requirements) Order 2022. The consequential amendments remove references to authorised rapid antigen tests (which were defined by reference to the principal order).

This order comes into force on 28 April 2023 and revokes itself on 28 May 2023.

Approval by resolution required

This order must be approved by resolution of the House of Representatives before the expiry of the period described in section 16(2) of the COVID-19 Public Health Response Act 2020. If this does not happen, and if the order has not already revoked itself, the order is revoked on the expiry of that period.

1 General

This is a consolidation of the COVID-19 Public Health Response (Point-of-care Tests) Order Revocation Order 2023 that incorporates the amendments made to the legislation so that it shows the law as at its stated date.

2 Legal status

A consolidation is taken to correctly state, as at its stated date, the law enacted or made by the legislation consolidated and by the amendments. This presumption applies unless the contrary is shown.
