These regulations are made under section 422 of the Social Security Act 2018 on the advice and with the consent of the Executive Council.

Regulations

1 Title

These regulations are the Social Security (Cash Assets and Income Exemptions—Kāinga Ora Energy Subsidy) Amendment Regulations 2023.

2 Commencement

These regulations come into force on 12 May 2023.

3 Principal regulations

These regulations amend the Social Security Regulations 2018.

4 Schedule 8 amended

(1)

In Schedule 8, clause 4, after item 28, insert:

29A Kāinga Ora energy subsidy to which clause 60 appliesNot income for the person in relation to whom the subsidy was paid

In Schedule 8, after Part 33, insert the Part 34 set out in the Schedule of these regulations.

Part 34 Kāinga Ora energy subsidies

59 Interpretation

In this Part, Kāinga Ora energy subsidy means a subsidy paid by Kāinga Ora to an energy retailer for the supply of electricity to a person residing in Kāinga Ora housing (as defined in section 2(1) of the Public and Community Housing Management Act 1992).

60 Energy subsidy

This clause applies to a Kāinga Ora energy subsidy.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 12 May 2023, amend Schedule 8 of the Social Security Regulations 2018.

The amendments will ensure that an energy subsidy paid by Kāinga Ora to an energy retailer for the supply of electricity to a person residing in Kāinga Ora housing is not treated as the person’s income for the purposes of the Social Security Act 2018.
