1 Title

This determination is the Judicial Officers Salaries and Allowances (2022/23) Amendment Determination 2023.

2 Commencement

This determination is deemed to have come into force on 11 April 2023.

4 Clause 11 amended (Definition of Coroner for purposes of clauses 12 and 13)

In clause 11(a), after “104,”, insert “104A,”.

5 Clause 12 amended (Salaries of Chief Coroner, Deputy Chief Coroner, Coroner, and Relief Coroner)

An Associate Coroner appointed under section 104A of the Coroners Act 2006 is entitled to an additional payment of up to $6,000 per annum by way of salary, in recognition of the fact that an Associate Coroner is not entitled to receive superannuation contributions under the Judicial Officers Superannuation Determination 2019, provided that the annual sum of the following amounts does not exceed $206,000:

(a)

the salary payable under subclause (2); and

(b)

any additional payment under this subclause; and

(c)

any superannuation subsidy (inclusive of any tax liability) that the Associate Coroner is entitled to be paid by the Crown otherwise than under the Judicial Officers Superannuation Determination 2019.

6 Clause 13 amended (Allowance of Chief Coroner, Deputy Chief Coroner, Coroner, and Relief Coroner)

Explanatory memorandum

This memorandum is not part of the determination, but is intended to indicate its general effect.

This determination, which is deemed to have come into force on 11 April 2023, amends the Judicial Officers Salaries and Allowances (2022/23) Determination 2022 (the principal determination).

The Coroners Amendment Act 2023 has established the position of Associate Coroner, and under that Act the remuneration for the new position will be determined by the Remuneration Authority. This determination sets the salary and additional payment for the Associate Coroner.

Because the Associate Coroner has a fixed-term appointment, they will be entitled to receive an additional payment of up to $6,000 per annum in recognition of the fact that an Associate Coroner is not entitled to receive superannuation contributions under the Judicial Officers Superannuation Determination 2019. This is consistent with the treatment of Relief Coroners, who also have fixed-term appointments.

The Associate Coroner may carry out the functions of a Duty Coroner as prescribed in the Coroners Act 2006 and, if so, will be entitled to receive the allowance stipulated in clause 13 of the principal determination. The allowance is paid in recognition of the fact that each Associate Coroner, from time to time, may be rostered to act as the National Duty Coroner.
