Judicial Officers Superannuation Amendment Determination 2023

This determination (to which is appended an explanatory memorandum) is made by the Remuneration Authority under section 12B(2) of the Remuneration Authority Act 1977.


1 Title

This determination is the Judicial Officers Superannuation Amendment Determination 2023.

2 Commencement

This determination is deemed to have come into force on 11 April 2023.

3 Principal determination
4 Clause 5 amended (Maximum subsidy on annual superannuation contribution)

After clause 5(2)(b)(ii), insert:


an associate coroner appointed under section 104A of the Coroners Act 2006; and

Explanatory memorandum

This memorandum is not part of the determination, but is intended to indicate its general effect.

This determination, which is deemed to have come into force on 11 April 2023, amends the Judicial Officers Superannuation Determination 2019 (the principal determination).

The Coroners Amendment Act 2023 (the amendment Act) has established the position of associate coroner and, under that Act, the superannuation rights or otherwise for the new position will be determined by the Remuneration Authority.

Under the principal determination, Judges and relief coroners who are appointed to their roles in an acting, fixed-term, or temporary capacity are not entitled to the superannuation subsidy stipulated in clause 5 of the principal determination. This determination ensures that an associate coroner is treated consistently with those Judges and relief coroners because an associate coroner is a fixed-term appointment under the amendment Act.
