Order in Council

At Wellington this 22nd day of May 2023

Present:
Her Excellency the Governor-General in Council

This order is made under section 15 of the Epidemic Preparedness Act 2006 on the advice and with the consent of the Executive Council and on the recommendation of the Minister of Customs.

Order

1 Title

This order is the Epidemic Preparedness (Customs and Excise Act 2018—Appeals) Immediate Modification Revocation Order 2023.

2 Commencement

This order comes into force on 22 June 2023.

4 Revocation of this order

This order is revoked on 20 July 2023.

Rachel Hayward,
Clerk of the Executive Council.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on 22 June 2023, revokes the Epidemic Preparedness (Customs and Excise Act 2018—Appeals) Immediate Modification Order 2020 (the principal order). The principal order modifies clause 15(2) of Schedule 8 of the Customs and Excise Act 2018.

The effect of this modification is to allow a Customs Appeal Authority to accept an application for an extension of time to bring an appeal if it is made no later than 20 working days after the Epidemic Preparedness (COVID-19) Notice 2020 expires or is revoked.

That notice expired on 20 October 2022 (see Gazette 2022-sl3849). Accordingly, the principal order is no longer required.

This order is itself revoked on 20 July 2023.

Issued under the authority of the Legislation Act 2019.

Date of notification in Gazette: 25 May 2023.

This order is administered by the New Zealand Customs Service.
