Preamble
At Wellington this 26th day of June 2006
Pursuant to section 37 of the Misuse of Drugs Act 1975, Her Excellency the Administrator of the Government, acting on the advice and with the consent of the Executive Council, makes the following regulations.

1 Title
These regulations are the Misuse of Drugs Amendment Regulations 2006.
2 Commencement
These regulations come into force on 1 August 2006.
3 Principal regulations amended
These regulations amend the Misuse of Drugs Regulations 1977.
4 Interpretation
Regulation 2(1) is amended by inserting the following definition in its appropriate alphabetical order:
“industrial hemp has the same meaning as in the Misuse of Drugs (Industrial Hemp) Regulations 2006”.
5 New regulation 3A inserted
The following regulation is inserted after regulation 3:
“3A Application to industrial hemp

“(1) No licence under these regulations may be issued in respect of industrial hemp.
“(2) Despite subclause (1), a licence may, in accordance with regulation 7, be issued to import or export industrial hemp.”

6 Transitional provision
To the extent that any licence granted, before the commencement of these regulations, under the Misuse of Drugs Regulations 1977, relates to industrial hemp, the licence—
(a) must be treated as if regulation 5 had not been made; and
(b) continues, unless sooner revoked, to have effect until the expiry of the period for which it has been granted.

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on 1 August 2006, amend the Misuse of Drugs Regulations 1977 so as to provide that a licence may not be issued under those regulations in relation to industrial hemp except in relation to the import and export of industrial hemp. A transitional provision provides for the continuing in effect of a licence issued before the commencement of these regulations.
