Repeal of Section 13 of the Factories and Commercial Premises Act 1981: revoked, on 6 November 2008, by clause 3 of the Regulations Revocation Order 2008 (SR 2008/367).

This order is administered in the Department of Labour.
PURSUANT to section 13(6) of the Factories and Commercial Premises Act 1981, and on the recommendation of the Minister of Labour, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.
1 Commencement
This order shall come into force on the day after the date of its notification in the Gazette.
2 Repeal
Section 13 of the Factories and Commercial Premises Act 1981 is hereby repealed.

Explanatory note
This note is not part of the order, but is intended to indicate its general effect.
This order repeals section 13 of the Factories and Commercial Premises Act 1981, which imposes on the employment of women in factories certain restrictions that do not apply to the employment of men in factories. The section is in part a result of New Zealand's having in the past been a party to International Labour Organisation Convention 89 covering Night Work of Women Employed in Industry. Subsection (6) of the section empowers the repeal of the section by Order in Council on the recommendation of the Minister of Labour, and subsection (7) prohibits the Minister from making the necessary recommendation unless he is satisfied that New Zealand is no longer bound by the convention. New Zealand registered a denunciation of the convention on 23 March 1981, and this came into force on 23 March 1982.
