Note
These regulations are administered in the Department of Conservation.
PURSUANT to sections 48 and 48A of the Conservation Act 1987, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, makes the following regulations.
Contents
1 Title and commencement

(1) These regulations may be cited as the Freshwater Fisheries Amendment Regulations 1997, and are part of the Freshwater Fisheries Regulations 19831 (
“the principal regulations”
).(2) These regulations come into force on 1 October 1997.
2 Interpretation
-
(1) Section 2(1) of the principal regulations is amended—
(a) By revoking the definition of the term adult licence:
(b) By revoking the definition of the term junior licence (as inserted by regulation 2 of the Freshwater Fisheries Regulations 1983, Amendment No 1):
(c) By revoking the definitions of the terms new participant and young adult (as inserted by regulation 2 of the Freshwater Fisheries Regulations 1983, Amendment No 18).
(2) Section 2(1) of the principal regulations is amended by revoking the definition of the term licence, and substituting the following definition:
“Licence means a licence to take acclimatised fish issued in accordance with these regulations and in accordance with a notice in the Gazette”.
(3) The following regulations are consequentially revoked:
(a) So much of regulation 2 of the Freshwater Fisheries Regulations 1983, Amendment No 1 as relates to the definition of the term junior licence:
(b) Regulation 2 of the Freshwater Fisheries Regulations 1983, Amendment No 18.
3 Classes and forms of licences
The principal regulations are amended by revoking regulation 4, and substituting the following regulation:

Licences issued to take acclimatised fish must be in the forms and for the classes fixed by notice in the Gazette.”
4 Licence fees

(1) The principal regulations are amended by revoking regulation 14 (as amended by regulation 2(1) of the Freshwater Fisheries Regulations 1983, Amendment No 6), and substituting the following regulation:

The fees fixed by notice in the Gazette for a licence must be paid and received for that licence.”
(2) Regulation 2(1) of the Freshwater Fisheries Regulations 1983, Amendment No 6 is consequentially revoked.
5 Reduction or waiver of fees
Regulation 15 of the principal regulations is amended by omitting the words
“these regulations prescribing”
, and substituting the words“a Gazette notice fixing”
.
6 Revocations
The following regulations are revoked:
(b) Regulation 4 of the Freshwater Fisheries Regulations 1983, Amendment No 1:
(c) Regulation 2 of the Freshwater Fisheries Regulations 1983, Amendment No 10:
(d) Regulation 2 of the Freshwater Fisheries Regulations 1983, Amendment No 11:
(e) Regulation 7 of the Freshwater Fisheries Regulations 1983, Amendment No 18:
(f) The Freshwater Fisheries Regulations 1983, Amendment No 19.

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on 1 October 1997, amend or revoke those provisions of the Freshwater Fisheries Regulations 1983 relating to classes of licences and licence fees. The definition of licence is also amended. The Conservation Amendment Act (No 3) 1996 amended the Conservation Act 1987 to allow the forms and classes of licences to fish for sports fish, the scope and effect of licences to fish for sports fish, the availability of licences to fish for sports fish, and the fees payable for those licences to be fixed by notice in the Gazette.
