The Parliamentary Counsel Office has made editorial and format changes to this version using the powers under subpart 2 of Part 3 of the Legislation Act 2019.

The Parliament of New Zealand enacts as follows:

1 Title

This Act is the Therapeutic Products Act Repeal Act 2024.

2 Commencement

This Act comes into force on the day after Royal assent.

Part 1 Repeal of Therapeutic Products Act 2023 and related matters

3 Repeal of Therapeutic Products Act 2023

The Therapeutic Products Act 2023 (2023 No 37) is repealed.

Consequential amendments to Food Act 2014

4 Principal Act

Sections 5 and 6 amend the Food Act 2014.

5 Section 413 amended (Overview of transitional provisions)

Repeal section 413(3).

6 Section 420 amended (Pre-commencement legislative requirements: Food Act 1981 and regulations)

Replace section 420(3) with:

The Dietary Supplements Regulations 1985—

(a)

continue in force as if made under this Act; and

(b)

are to be treated as if made under sections 343 and 383 of this Act; and

(c)

may be amended or revoked as if made under this Act.

Consequential amendments to Dietary Supplements Regulations 1985

7 Principal regulations

Sections 8 and 9 amend the Dietary Supplements Regulations 1985.

8 New regulation 2B inserted (Adopted joint food standards do not apply to dietary supplements)

After regulation 2A, insert:

2B Adopted joint food standards do not apply to dietary supplements

The adopted joint food standards do not apply to dietary supplements.

9 Part 3 revoked

Revoke Part 3.

Part 2 Repeal of this Act

10 Repeal of this Act

This Act is repealed on the close of the 28th day after the date on which it comes into force.

1 General

This is a consolidation of the Therapeutic Products Act Repeal Act 2024 that incorporates the amendments made to the legislation so that it shows the law as at its stated date.

2 Legal status

A consolidation is taken to correctly state, as at its stated date, the law enacted or made by the legislation consolidated and by the amendments. This presumption applies unless the contrary is shown.
