Fisheries (Challenger Area Commercial Fishing) Amendment Regulations (No 2) 2004
Note
These regulations are administered in the Ministry of Fisheries.
Pursuant to section 297 of the Fisheries Act 1996, Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.
1 Title
-
(1) These regulations are the Fisheries (Challenger Area Commercial Fishing) Amendment Regulations (No 2) 2004.
(2) In these regulations, the Fisheries (Challenger Area Commercial Fishing) Regulations 19861 are called
“the principal regulations”
.
2 Commencement
These regulations come into force on the 28th day after the date of their notification in the Gazette.
3 Interpretation
Regulation 2(1) of the principal regulations is amended by revoking the definition of the term green-lipped mussel spat.
5 Offences
Regulation 15(1) of the principal regulations is amended by omitting the expression
“14C,”

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on the 28th day after the date of their notification in the Gazette, amend the Fisheries (Challenger Area Commercial Fishing) Regulations 1986.
The definition of green-lipped mussel spat is revoked because a new definition has been included in amendments to the Fisheries (Reporting) Regulations 2001.
Regulation 14C is also revoked. That regulation made it an offence to take kina for the purposes of sale by any other method than hand gathering unless that method was specifically authorised by a fishing permit. The regulation setting out the penalties for offences is also consequentially amended. The reason for these amendments is that kina is now managed within the quota management system.
