These regulations are made under section 297 of the Fisheries Act 1996 on the advice and with the consent of the Executive Council.

Regulations
1 Title
These regulations are the Fisheries (Challenger Area Commercial Fishing) Amendment Regulations 2025.
2 Commencement
These regulations come into force on 10 April 2025.
3 Principal regulations
These regulations amend the Fisheries (Challenger Area Commercial Fishing) Regulations 1986.
4 New regulation 11A inserted (Use of spears prohibited in defined areas)
After regulation 11, insert:
11A Use of spears prohibited in defined areas
Commercial fishers must not use spears to take fish, and must not possess fish that have been speared, within the following waters:
(a)
Eastern Tasman Bay and Marlborough Sounds—the waters within the area enclosed by a line that—
(i)
commences at a point on Tāhunanui Beach (at 41°16.741′S and 173°14.717′E); and
(ii)
then proceeds in a straight line in a northerly direction to a point at 41°15.556′S and 173°14.860′E; and
(iii)
then proceeds in a straight line in a north-easterly direction to a point at 41°14.957′S and 173°15.335′E; and
(iv)
then proceeds in a straight line in a north-easterly direction to a point at 41°11.781′S and 173°18.961′E; and
(v)
then proceeds in a straight line in a north-easterly direction to a point at 41°07.986′S and 173°24.249′E; and
(vi)
then proceeds in a straight line in a north-easterly direction to a point at 41°05.787′S and 173°30.630′E; and
(vii)
then proceeds in a straight line in a north-easterly direction to a point at 41°03.621′S and 173°33.702′E; and
(viii)
then proceeds in a straight line in a north-easterly direction to a point at 41°02.663′S and 173°35.335′E; and
(ix)
then proceeds in a straight line in a north-easterly direction to a point at 41°01.850′S and 173°37.832′E; and
(x)
then proceeds in a straight line in a north-easterly direction to a point at 41°01.603′S and 173°38.855′E; and

then proceeds in a straight line in a north-easterly direction to a point at 40°59.768′S and 173°42.958′E; and

then proceeds in a straight line in a northerly direction to a point at 40°48.897′S and 173°46.974′E; and

then proceeds in a straight line in an easterly direction to Two Bay Point on D’Urville Island (at 40°48.897′S and 173°47.641′E); and
(xvi)
then proceeds along the mean high-water mark of D’Urville Island in a generally southerly direction towards Sauvage Point and continues in a north-easterly direction to a point on D’Urville Peninsula (at 40°51.640′S and 173°54.920′E); and
(xvii)
then proceeds in a straight line in an easterly direction to a point at 40°51.640′S and 173°55.575′E; and
(xviii)
then proceeds in a straight line in a south-easterly direction to a point at 40°52.893′S and 173°59.145′E; and
(xix)
then proceeds in a straight line in a south-easterly direction to a point at 40°54.180′S and 174°01.716′E; and
(xx)
then proceeds in a straight line in a south-easterly direction to a point at 40°55.998′S and 174°05.267′E; and
(xxi)
then proceeds in a straight line in a south-easterly direction to a point at 40°56.427′S and 174°08.452′E; and
(xxii)
then proceeds in a straight line in a south-easterly direction to a point at 40°58.625′S and 174°14.128′E; and
(xxiii)
then proceeds in a straight line in a generally easterly direction to a point at 40°59.116′S and 174°18.909′E; and
(xxiv)
then proceeds in a straight line in a south-easterly direction to a point at 40°59.325′S and 174°19.430′E; and
(xxv)
then proceeds in a straight line in a south-easterly direction to a point at 41°04.785′S and 174°22.925′E; and
(xxvi)
then proceeds in a straight line in a southerly direction to Cape Koamaru (at 41°05.293′S and 174°22.925′E); and
(xxvii)
then proceeds along the mean high-water mark of the western coast of Arapaoa Island to East Head (at 41°12.632′S and 174°19.402′E); and
(xxviii)
then proceeds in a straight line in a south-westerly direction to West Head (at 41°12.793′S and 174°18.949′E); and
(xxix)
then proceeds along the mean high-water mark to the commencement point on Tāhunanui Beach (at 41°16.741′S and 173°14.717′E):
(b)
Port Underwood—the waters within the area enclosed by a line that—
(i)
commences at Robertson Point (at 41°21.069′S and 174°07.252′E); and
(ii)
then proceeds in a straight line in a south-westerly direction to a point at 41°23.557′S and 174°04.604′E; and
(iii)
then proceeds in a straight line in a westerly direction to a point at the north end of Te Koko-o-Kupe / Cloudy Bay (at 41°23.557′S and 174°02.968′E); and
(iv)
then proceeds along the mean high-water mark to the commencement point at Robertson Point (at 41°21.069′S and 174°07.252′E).
5 Regulation 12 amended (Conditions for taking oysters)
In regulation 12(1)(a), delete “the Fisheries Act 1983 or”

6 Regulation 12A amended (Conditions and restrictions relating to scallops)

Explanatory note
This note is not part of the regulations but is intended to indicate their general effect.
These regulations, which come into force on 10 April 2025, amend the Fisheries (Challenger Area Commercial Fishing) Regulations 1986 (the principal regulations).
Regulation 4 inserts new regulation 11A into the principal regulations. New regulation 11A prohibits the use of spears by commercial fishers within defined areas. Regulation 15 of the principal regulations sets out offences for contravening or failing to comply with specified regulations. Regulation 7 amends regulation 15(1) to include an offence for contravening or failing to comply with new regulation 11A.
Regulation 12A of the principal regulations sets out conditions and restrictions relating to scallops. Regulation 6(2) amends regulation 12A(1)(a) and (b) and (4) to prohibit commercial fishers from diving for scallops in specified circumstances.
Regulations 5 and 6(1) delete references to the Fisheries Act 1983 (which is now repealed) from the principal regulations.
