Pursuant to the Companies Special Investigations Act 1958, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, and, in relation to clause 2, on the advice of the Minister of Justice given on the recommendation of the Securities Commission, hereby makes the following order.

Order

1 Title and commencement

(1)

This order may be cited as the Companies Special Investigations Order (No 5) 1989.

(2)

This order shall come into force at 6 pm on 20 March 1989.

2 Act to apply to certain companies

It is hereby declared that the Companies Special Investigations Act 1958 shall apply to the companies named in Schedule 1.

3 Receivers and managers

Frederick Nelson Watson, of Auckland, chartered accountant, and Graeme George McDonald, of Auckland, chartered accountant, are hereby appointed receivers and managers in respect of each company to which the Companies Special Investigations Act 1958 applies by virtue of clause 2.

4 Release of certain companies from application of Companies Special Investigations Act 1958

It is hereby declared that the Companies Special Investigations Act 1958 shall cease to apply to the companies named in Schedule 2.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force at 6 pm on 20 March 1989, relates to the Richmond Smart group of companies. The order applies the Companies Special Investigations Act 1958 to 6 additional companies each of which is incorporated in New Zealand.

The receivers and managers appointed in respect of those companies are the same as those appointed by the Companies Special Investigations Order (No 3) 1989 in respect of the companies to which that order relates.

The order also declares that the Companies Special Investigations Act 1958 shall cease to apply to 9 companies named in that order.

1 General

This is a consolidation of the Companies Special Investigations Order (No 5) 1989 that incorporates the amendments made to the legislation so that it shows the law as at its stated date.

2 Legal status
