Note
These regulations are administered in the Ministry for the Environment.
Pursuant to section 360 of the Resource Management Act 1991, Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.
Contents
1 Title
-
(1) These regulations are the Resource Management (Transitional, Fees, Rents, and Royalties) Amendment Regulations 2003
(2) In these regulations, the Resource Management (Transitional, Fees, Rents, and Royalties) Regulations 19911 are called
“the principal regulations”
2 Commencement
These regulations come into force on the 28th day after the date of their notification in the Gazette.
3 Payment of rents and royalties for existing licences, leases, permits, etc

(1) Regulation 7(1) of the principal regulations is amended by repealing paragraph (a), and substituting the following paragraph:
“(a) licence, permit, approval, or authorisation referred to in section 384(1)(b) or (c) of the Act; and.”
(2) Regulation 7(1) of the principal regulations is amended by omitting the words
“under such instrument or Order in Council.”

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on the 28th day after the date of their notification in the Gazette, amend the Resource Management (Transitional, Fees, Rents, and Royalties) Regulations 1991.
The effect of the amendments is to extend transitional arrangements relating to the payment of rents and royalties to licences, permits, and authorities granted under special Acts within the meaning of the Harbours Act 1950 or any other enactment that provides for a right of occupation. The persons entitled to receive the rents and royalties in respect of these licences, permits, and authorities immediately before commencement of the Resource Management Act 1991 continue to be entitled to receive the rents and royalties.
